Biography description
Emily Durst is a commercial litigator with a practice focused on construction and commercial disputes. Emily has significant experience acting on matters involving Construction Act lien and trust claims, payment disputes, construction deficiencies, delay claims, and other disputes arising from commercial and residential construction projects. She works closely with general contractors, subcontractors and trade contractors, developers and owners, sureties, lenders, suppliers and insurers at every stage of the construction process, providing strategic advice during the course of a project to help manage legal risk and, where disputes arise, representing clients through negotiation, litigation, and trial where necessary.
In addition to her construction practice, Emily regularly acts in complex commercial litigation, including shareholder and partnership disputes, commercial leasing matters, contractual disputes, debt recovery, and other business conflicts. She is known for delivering practical, strategic advice tailored to her clients’ legal and commercial objectives. She advises and represents clients in a broad range of litigation matters. Emily has appeared before the Ontario Superior Court of Justice, the Divisional Court, the Court of Appeal for Ontario, and private arbitral tribunals, advocating for clients at every stage of the dispute resolution process.
Emily is a Director of the Centre in the Square Inc., Kitchener’s premier performing arts centre. She is also an active member of the legal community and maintains memberships in several professional and industry associations.
