R. v. Greater Sudbury: Owner’s Obligations (and Potential Liability) as an Employer under OHSA

In November 2023 the Supreme Court of Canada issued its decision in R. v. Greater Sudbury (City) dealing with the obligations (and liabilities) of project owners in Ontario under the Occupational Health and Safety Act. The decision affects every owner that undertakes a construction project, large or small.

Dražen Bulat, Bryan Buttigieg and Lori Goldberg of Miller Thomson LLP’s Construction and Environment Groups hosted an interactive panel discussion about the decision, including:

  • What did the Court decide?
  • What is the impact of the decision on owners?
  • What steps can owners take to mitigate or reduce the risk of liability?
