Proposed Amendments to the Valuation for Duty Regulations

The Govt. of Canada is proposing amendments to the Valuation for Duty Regulations and the Customs Act. The CBSA recently published a summary of the proposed amendments in the Canada Gazette and has requested a consultative process which will terminate on June 26, 2023.

The amendments will make the “last sale” in a series of sales to import goods into Canada as the sale to be used as the basis for appraising the value for duty to be declared to the CBSA. These amendments will likely raise costs for Canadian consumers as well as significantly impact e-commerce importations and importations by non-resident importers (“NRIs”).
