Pour plus de d\u00e9tails, veuillez consulter notre <a href=\"https:\/\/www.millerthomson.com\/fr\/perspectives-juridiques\/impact-social\/budget-federal-de-2025-points-saillants-pour-le-secteur-des-organismes-de-bienfaisance-et-des-obnl\/\">num\u00e9ro sp\u00e9cial consacr\u00e9 au budget f\u00e9d\u00e9ral de 2025<\/a>.<\/em><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p>Dans un <a href=\"https:\/\/www.millerthomson.com\/fr\/perspectives-juridiques\/impact-social\/interdiction-possible-des-importants-dons-en-especes-imposee-par-les-nouvelles-regles-du-federal-ce-que-les-organismes-de-bienfaisance-et-sans-but-lucratif-doivent-savoir\/?utm_source=linkedin&#038;utm_medium=social&#038;utm_campaign=social-impact-2025-september-24\">r\u00e9cent article<\/a>, nous avons soulign\u00e9 que le gouvernement du Canada avait propos\u00e9 l\u2019interdiction des op\u00e9rations en esp\u00e8ces de plus de 10\u2009000&nbsp;$ (y compris les dons) dans le <a href=\"https:\/\/www.parl.ca\/documentviewer\/fr\/45-1\/projet-loi\/C-2\/premiere-lecture\">projet de loi&nbsp;C-2<\/a> intitul\u00e9 <em>Loi concernant certaines mesures li\u00e9es \u00e0 la s\u00e9curit\u00e9 de la fronti\u00e8re entre le Canada et les \u00c9tats-Unis et d\u2019autres mesures connexes li\u00e9es \u00e0 la s\u00e9curit\u00e9<\/em>, initialement pr\u00e9sent\u00e9 en juin (le \u00ab&nbsp;<strong>projet de loi initial&nbsp;<\/strong>\u00bb).<\/p>\n\n\n\n<p>Le 8&nbsp;octobre 2025, le gouvernement a pr\u00e9sent\u00e9 le <a href=\"https:\/\/www.parl.ca\/documentviewer\/fr\/45-1\/projet-loi\/C-12\/premiere-lecture\">projet de loi&nbsp;C-12<\/a> intitul\u00e9 <em>Loi concernant certaines mesures li\u00e9es \u00e0 la s\u00e9curit\u00e9 de la fronti\u00e8re canadienne et \u00e0 l\u2019int\u00e9grit\u00e9 du syst\u00e8me d\u2019immigration canadien et d\u2019autres mesures connexes li\u00e9es \u00e0 la s\u00e9curit\u00e9<\/em>, dont l\u2019objectif consiste \u00e0 mettre en \u0153uvre plus rapidement plusieurs des mesures les moins contest\u00e9es du projet de loi initial. Le gouvernement a pris cette d\u00e9cision \u00e0 la suite des critiques re\u00e7ues de la part de certaines associations de d\u00e9fense des libert\u00e9s civiles et d\u2019autres parties prenantes, notamment la section des organismes de bienfaisance et \u00e0 but non lucratif de l\u2019Association du Barreau canadien, \u00e0 l\u2019\u00e9gard de plusieurs dispositions du projet de loi initial.<\/p>\n\n\n\n<p>\u00c0 notre connaissance, le projet de loi&nbsp;C-2 est toujours \u00e0 l\u2019\u00e9tude par le Parlement, mais les dispositions relevant du projet de loi C-12 seront retir\u00e9es du projet de loi&nbsp;C-2 initial. Il est important de souligner que les mesures concernant l\u2019interdiction des dons de sommes importantes en esp\u00e8ces n\u2019ont pas \u00e9t\u00e9 int\u00e9gr\u00e9es au projet de loi&nbsp;C-12, et il reste \u00e0 d\u00e9terminer si elles seront adopt\u00e9es avec les autres dispositions du projet de loi&nbsp;C-2. Dans son <a href=\"https:\/\/www.canada.ca\/fr\/securite-publique-canada\/nouvelles\/2025\/10\/le-gouvernement-du-canada-depose-une-nouvelle-legislation-simplifiee-pour-renforcer-la-securite-de-la-frontiere-et-assurer-la-securite-des-canadiens.html\">communiqu\u00e9 de presse<\/a>, S\u00e9curit\u00e9 publique Canada a d\u00e9clar\u00e9 que \u00ab&nbsp;Le nouveau projet de loi&nbsp;C-12 a \u00e9t\u00e9 d\u00e9pos\u00e9 pour permettre au Parlement d\u2019adopter ces priorit\u00e9s afin de prot\u00e9ger les Canadiens tout en accordant plus de temps pour examiner les autres mesures annonc\u00e9es en juin 2025.&nbsp;\u00bb<\/p>\n\n\n\n<p>Ces projets de loi continuent de progresser dans leur processus d\u2019adoption.
