{"id":11826,"date":"2022-11-09T19:00:17","date_gmt":"2022-11-10T00:00:17","guid":{"rendered":"https:\/\/www.millerthomson.com\/nouvelle-reglementation-federale-pour-les-conges-de-maladie-payes\/"},"modified":"2022-11-09T19:00:17","modified_gmt":"2022-11-10T00:00:17","slug":"nouvelle-reglementation-federale-pour-les-conges-de-maladie-payes","status":"publish","type":"post","link":"https:\/\/www.millerthomson.com\/fr\/perspectives-juridiques\/droit-du-travail-et-droit-de-lemploi\/nouvelle-reglementation-federale-pour-les-conges-de-maladie-payes\/","title":{"rendered":"Avis aux employeurs\u00a0: Nouvelle r\u00e9glementation f\u00e9d\u00e9rale pour les cong\u00e9s de maladie pay\u00e9s d\u00e8s le mois prochain"},"content":{"rendered":"<p>Le lundi 7\u00a0novembre\u00a02022, le gouvernement f\u00e9d\u00e9ral a publi\u00e9 la version d\u00e9finitive du r\u00e8glement pris en vertu du <em>Code canadien du travail<\/em> qui accorde dix jours de cong\u00e9 de maladie pay\u00e9 aux employ\u00e9s des secteurs sous r\u00e9glementation f\u00e9d\u00e9rale (aviation, t\u00e9l\u00e9communications, transport interprovincial et banques).<\/p>\n<p>Au 31\u00a0d\u00e9cembre\u00a02022, les employ\u00e9s qui ont travaill\u00e9 sans interruption pendant au moins 30\u00a0jours auront droit \u00e0 trois jours de cong\u00e9 de maladie pay\u00e9. \u00c0 compter du 1<sup>er<\/sup>\u00a0f\u00e9vrier\u00a02023, les employ\u00e9s accumuleront un quatri\u00e8me jour de cong\u00e9 de maladie pay\u00e9, auquel s\u2019ajoutera un jour chaque mois suivant, jusqu\u2019\u00e0 concurrence de dix jours par ann\u00e9e.<\/p>\n<p>Les cong\u00e9s inutilis\u00e9s seront report\u00e9s \u00e0 l\u2019ann\u00e9e civile suivante, mais seront soustraits du nombre de jours pouvant \u00eatre accumul\u00e9s dans cette nouvelle ann\u00e9e.<\/p>\n<p>Les employeurs peuvent demander \u00e0 un employ\u00e9 de fournir un certificat m\u00e9dical s\u2019il s\u2019absente pendant cinq jours cons\u00e9cutifs ou plus.<\/p>\n<p>Les employeurs devront conserver les renseignements suivants pour chaque p\u00e9riode de cong\u00e9 de maladie pay\u00e9\u00a0:<\/p>\n<ul>\n<li>les dates de d\u00e9but et de fin du cong\u00e9;<\/li>\n<li>l\u2019ann\u00e9e de service pour laquelle le cong\u00e9 a \u00e9t\u00e9 acquis;<\/li>\n<li>le nombre de jours de cong\u00e9 report\u00e9s d\u2019une ann\u00e9e pr\u00e9c\u00e9dente;<\/li>\n<li>une copie de toute demande \u00e9crite de certificat m\u00e9dical pr\u00e9sent\u00e9e par l\u2019employeur;<\/li>\n<li>une copie de tout certificat m\u00e9dical pr\u00e9sent\u00e9 par l\u2019employ\u00e9.<\/li>\n<\/ul>\n<p>Les employ\u00e9s en cong\u00e9 de maladie pay\u00e9 qui sont pay\u00e9s autrement qu\u2019en fonction du temps (p. ex. les vendeurs pay\u00e9s \u00e0 commission) auront le droit d\u2019\u00eatre r\u00e9mun\u00e9r\u00e9s \u00e0 leur \u00ab\u00a0taux salarial normal\u00a0\u00bb de la m\u00eame fa\u00e7on qu\u2019ils le sont pour les jours f\u00e9ri\u00e9s et autres cong\u00e9s pay\u00e9s au titre du <em>Code canadien du travail<\/em>.<\/p>\n<p>Vous trouverez des renseignements suppl\u00e9mentaires dans le <a href=\"https:\/\/www.canada.ca\/fr\/emploi-developpement-social\/nouvelles\/2022\/11\/le-ministre-oregan-annonce-la-version-finale-du-reglement-permettant-lentree-en-vigueur-des-dix-jours-de-conge-de-maladie-paye.html\" target=\"_blank\" rel=\"noopener\">communiqu\u00e9 de presse<\/a> du gouvernement.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Le lundi 7\u00a0novembre\u00a02022, le gouvernement f\u00e9d\u00e9ral a publi\u00e9 la version d\u00e9finitive du r\u00e8glement pris en vertu du Code canadien du travail qui accorde dix jours de cong\u00e9 de maladie pay\u00e9 aux employ\u00e9s des secteurs sous r\u00e9glementation f\u00e9d\u00e9rale (aviation, t\u00e9l\u00e9communications, transport interprovincial et banques).
