{"id":11703,"date":"2022-06-02T12:13:56","date_gmt":"2023-08-12T08:04:04","guid":{"rendered":"https:\/\/www.millerthomson.com\/limportance-de-la-mise-en-demeure\/"},"modified":"2023-08-12T04:04:04","modified_gmt":"2023-08-12T08:04:04","slug":"limportance-de-la-mise-en-demeure","status":"publish","type":"post","link":"https:\/\/www.millerthomson.com\/fr\/perspectives-juridiques\/bulletin-droit-de-la-construction-et-fr\/limportance-de-la-mise-en-demeure\/","title":{"rendered":"L&rsquo;importance de la mise en demeure"},"content":{"rendered":"<p>Dans une d\u00e9cision rendue r\u00e9cemment<a href=\"#_ftn1\" name=\"_ftnref1\"><sup>[1]<\/sup><\/a>, la Cour sup\u00e9rieure a r\u00e9it\u00e9r\u00e9 l\u2019importance de transmettre une mise en demeure pr\u00e9alablement \u00e0 l\u2019institution d\u2019un recours en dommages suivant l\u2019ex\u00e9cution fautive de travaux.<\/p>\n<h2>Faits<\/h2>\n<p>Dans cette affaire, la Coop\u00e9rative de solidarit\u00e9 en habitation Carpe Diem (\u00ab\u00a0<strong>Coop<\/strong>\u00a0\u00bb) octroie un contrat pour les travaux de d\u00e9molition de l\u2019\u00e9glise Sainte\u2011Bernadette-Soubirous situ\u00e9e dans le secteur Lauzon \u00e0 L\u00e9vis \u00e0 CFG Construction inc. (\u00ab\u00a0<strong>CFG<\/strong>\u00a0\u00bb) \u00e0 la suite d\u2019un appel d\u2019offres public. Ces travaux s\u2019inscrivent dans le cadre du projet de construction d\u2019un ensemble d\u2019habitations dont sera propri\u00e9taire la Coop, mais qui sera construit par un autre entrepreneur lors d\u2019une autre phase des travaux.<\/p>\n<p>Les documents d\u2019appel d\u2019offres en lien avec les travaux de d\u00e9molition pr\u00e9voient que \u00ab\u00a0<em>l\u2019entrepreneur a la possibilit\u00e9 de concasser les mat\u00e9riaux de b\u00e9ton et de pierre de ma\u00e7onnerie pour les utiliser sur place comme mat\u00e9riaux de remblayage\u00a0\u00bb. <\/em>Il est \u00e9galement mentionn\u00e9 que<em> \u00ab\u00a0l\u2019acier d\u2019armature doit \u00eatre retir\u00e9 du b\u00e9ton concass\u00e9 et \u00e9vacu\u00e9 hors du site\u00a0\u00bb. <\/em><\/p>\n<p>Les travaux de d\u00e9molition et de remblayage se sont termin\u00e9s \u00e0 la fin du mois de mars.<\/p>\n<p>D\u00e8s le 3\u00a0avril, l\u2019entrepreneur charg\u00e9 de l\u2019excavation pour les travaux de construction constate la pr\u00e9sence de grosses masses de b\u00e9ton, de morceaux de ma\u00e7onnerie, de blocs de terracotta, de tuyaux de fonte, de barres d\u2019armature, de pi\u00e8ces m\u00e9talliques pouvant mesurer jusqu\u2019\u00e0 cinq pieds de long et de morceaux de bois.<\/p>\n<p>Il se plaint alors de la mauvaise ex\u00e9cution des travaux de d\u00e9molition et de remblayage.<\/p>\n<p>CFG se d\u00e9fend en avan\u00e7ant que les normes d\u2019Environnement Qu\u00e9bec pr\u00e9voient une tol\u00e9rance de 1\u00a0% quant \u00e0 la pr\u00e9sence de mat\u00e9riaux non conformes, que la zone o\u00f9 les mat\u00e9riaux ind\u00e9sirables ont \u00e9t\u00e9 retrouv\u00e9s se situe \u00e0 l\u2019ext\u00e9rieur de la zone des travaux et qu\u2019aucune mise en demeure lui enjoignant de retirer les mat\u00e9riaux ne lui a \u00e9t\u00e9 transmise.<\/p>\n<h2>D\u00e9cision<\/h2>\n<p>Le tribunal d\u00e9termine que les sp\u00e9cifications des plans et devis ont pr\u00e9s\u00e9ance sur les normes d\u2019Environnement Qu\u00e9bec. Ce faisant, le remblayage de l&rsquo;acier d\u2019armature et des autres \u00e9l\u00e9ments identifi\u00e9s aux documents d\u2019appel d\u2019offres \u00e9tait proscrit.<\/p>\n<p>Le tribunal conclut \u00e9galement que des mat\u00e9riaux ind\u00e9sirables se trouvaient dans la zone de travaux de CFG. Cette derni\u00e8re ne r\u00e9pondait donc pas aux exigences contractuelles.<\/p>\n<p>Cependant, le tribunal conclut que CFG n\u2019a jamais \u00e9t\u00e9 mis en demeure de corriger ses travaux. CFG a re\u00e7u une liste de d\u00e9ficiences de la part des professionnels sept\u00a0jours apr\u00e8s la d\u00e9couverte du d\u00e9blai ill\u00e9gal. Un repr\u00e9sentant de CFG s\u2019est rendu sur les lieux le lendemain et a ni\u00e9 les reproches qui lui \u00e9taient adress\u00e9s. Ce dernier all\u00e9guait alors que les travaux \u00e9taient conformes.<\/p>\n<p>\u00c0 ce moment, la d\u00e9cision avait d\u00e9j\u00e0 \u00e9t\u00e9 prise de confier les travaux correctifs \u00e0 l\u2019entrepreneur responsable des travaux de construction afin de ne pas retarder le chantier et d\u2019\u00e9viter d\u2019avoir deux entrepreneurs g\u00e9n\u00e9raux sur le m\u00eame chantier. De ce fait, aucune mise en demeure de reprendre les travaux n\u2019a \u00e9t\u00e9 transmise \u00e0 CFG.<\/p>\n<p>\u00c0 la lumi\u00e8re de la preuve qui lui a \u00e9t\u00e9 pr\u00e9sent\u00e9e, le tribunal a d\u00e9termin\u00e9 qu\u2019il n\u2019y avait pas de situation d\u2019urgence permettant de passer outre l\u2019obligation de transmettre une mise en demeure. De plus, CFG n\u2019avait pas manifest\u00e9 son refus d\u2019effectuer les travaux correctifs; situation qui aurait dispens\u00e9 la Coop de transmettre une mise en demeure \u00e0 CFG.<\/p>\n<p>Face \u00e0 ce d\u00e9faut, le tribunal rejette la demande en remboursement de 496\u2009650,28\u00a0$ pr\u00e9sent\u00e9e par la Coop. Cette demande visait les co\u00fbts suppl\u00e9mentaires pay\u00e9s \u00e0 l\u2019entrepreneur charg\u00e9 de la construction du nouveau b\u00e2timent et \u00e0 ses professionnels ainsi que les co\u00fbts engendr\u00e9s pour la surveillance lors des travaux de tri et d\u2019acheminement de d\u00e9bris vers des sites de r\u00e9cup\u00e9ration en raison du remblayage non conforme r\u00e9alis\u00e9 par CFG.<\/p>\n<p>Au surplus, la Coop a \u00e9t\u00e9 condamn\u00e9e \u00e0 verser \u00e0 CFG le solde contractuel qui \u00e9tait demeur\u00e9 impay\u00e9.<\/p>\n<p>Bien que l\u2019obligation de mettre son d\u00e9biteur en demeure soit l\u2019objet d\u2019une jurisprudence abondante, il est encore fr\u00e9quent que des recours soient rejet\u00e9s en raison du d\u00e9faut de respecter cette obligation.<\/p>\n<p>Cette d\u00e9cision nous rappelle l\u2019importance de respecter cette exigence.<\/p>\n<p><a href=\"#_ftnref1\" name=\"_ftn1\"><sup>[1]<\/sup><\/a> <em>CFG Construction inc.<\/em> c. <em>Coop\u00e9rative de solidarit\u00e9 en habitation Carpe Diem<\/em>, 2022\u00a0QCCS 146<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Dans une d\u00e9cision rendue r\u00e9cemment[1], la Cour sup\u00e9rieure a r\u00e9it\u00e9r\u00e9 l\u2019importance de transmettre une mise en demeure pr\u00e9alablement \u00e0 l\u2019institution d\u2019un recours en dommages suivant l\u2019ex\u00e9cution fautive de travaux.
