Le 15\u00a0juillet dernier, la Cour d\u2019appel rendait un jugement visant l\u2019application de ces r\u00e8gles dans le cadre d\u2019un recours en ex\u00e9cution d\u2019une hypoth\u00e8que l\u00e9gale de la construction dans l\u2019affaire <em>Immeubles Prime inc. <\/em>c.<em> Patrick Morin inc. <\/em><a href=\"#_ftn1\" name=\"_ftnref1\"><sup>[1]<\/sup><\/a>. Elle en venait \u00e0 la conclusion que, dans les circonstances particuli\u00e8res de cette affaire, le fournisseur de mat\u00e9riaux <em>Patrick Morin inc.<\/em> b\u00e9n\u00e9ficiait de 10\u00a0ans pour intenter son recours hypoth\u00e9caire.<\/p>\n<p><strong>Les faits<\/strong><\/p>\n<p>Dans le cadre d\u2019un projet de construction et de r\u00e9novation d\u2019un immeuble appartenant \u00e0 <em>Immeubles Prime inc<\/em>. (\u00ab\u00a0<strong>Prime<\/strong>\u00a0\u00bb), <em>Patrick Morin inc.<\/em> (\u00ab\u00a0<strong>Patrick Morin<\/strong>\u00a0\u00bb) a fourni des mat\u00e9riaux \u00e0 un entrepreneur en construction, <em>6642641 Canada inc.<\/em> (\u00ab\u00a0<strong>664<\/strong>\u00a0\u00bb). Or, 664 n\u00e9glige de respecter les modalit\u00e9s de paiement pr\u00e9vues \u00e0 l\u2019entente et de payer les factures s\u2019\u00e9chelonnant du 13\u00a0novembre 2012 au 13\u00a0mars 2013.<\/p>\n<p>En avril 2013, dans l\u2019objectif de s\u00e9curiser sa cr\u00e9ance, Patrick Morin fait inscrire une hypoth\u00e8que l\u00e9gale de la construction sur l\u2019immeuble de Prime et, en juillet 2013, il poursuit ses d\u00e9marches en publiant un pr\u00e9avis d\u2019exercice d\u2019un recours hypoth\u00e9caire.<\/p>\n<p>Le 22\u00a0juillet 2015, toujours impay\u00e9, Patrick Morin intente une action sur compte \u00e0 l\u2019encontre de 664 et obtient gain de cause dans un jugement par d\u00e9faut dat\u00e9 du 22\u00a0septembre 2015. Malgr\u00e9 ce jugement condamnant 664 \u00e0 lui verser la somme de 55\u2009185,23\u00a0$, Patrick Morin demeure impay\u00e9.<\/p>\n<p>Le 10\u00a0mars 2016, soit pr\u00e8s de 3\u00a0ans apr\u00e8s l\u2019\u00e9mission de la quasi-totalit\u00e9 de ses factures, Patrick Morin intente, dans un ultime effort, un recours hypoth\u00e9caire en d\u00e9laissement forc\u00e9 et pour vente sous contr\u00f4le de justice de l\u2019immeuble d\u00e9tenu par Prime <a href=\"#_ftn2\" name=\"_ftnref2\"><sup>[2]<\/sup><\/a>.<\/p>\n<p>En d\u00e9fense, Prime invoque que le recours de Patrick Morin est prescrit quant aux factures \u00e9mises avant le 13\u00a0mars 2013, puisque le d\u00e9lai de prescription de 3\u00a0ans est \u00e9chu.<\/p>\n<p><strong>La d\u00e9cision de premi\u00e8re instance<\/strong><\/p>\n<p>Le juge de premi\u00e8re instance est d\u2019avis que trois hypoth\u00e8ses peuvent \u00eatre retenues quant \u00e0 la prescription applicable au recours hypoth\u00e9caire de Patrick Morin, mais que dans tous les cas, le recours hypoth\u00e9caire intent\u00e9 le 10\u00a0mars 2016 n\u2019est pas prescrit\u00a0:<\/p>\n<ol>\n<li>Le recours hypoth\u00e9caire est assujetti au d\u00e9lai de prescription de 10\u00a0ans de l\u2019article\u00a02924 CcQ, soit le d\u00e9lai de prescription rattach\u00e9 \u00e0 un jugement;<\/li>\n<li>Le recours hypoth\u00e9caire est assujetti au d\u00e9lai de prescription de 3\u00a0ans attach\u00e9 \u00e0 la cr\u00e9ance principale (art. 2925 CcQ);<\/li>\n<li>Le recours hypoth\u00e9caire est assujetti au d\u00e9lai de 10\u00a0ans pr\u00e9vu \u00e0 l\u2019article\u00a02923 CcQ, soit le d\u00e9lai de prescription qui s\u2019applique aux actions visant \u00e0 faire valoir un droit r\u00e9el immobilier.<\/li>\n<\/ol>\n<p><strong>La d\u00e9cision en appel<\/strong><\/p>\n<p>Non sans mentionner la controverse \u00e0 ce sujet <a href=\"#_ftn3\" name=\"_ftnref3\"><sup>[3]<\/sup><\/a>, la Cour d\u2019appel explique que pour d\u00e9terminer si un recours hypoth\u00e9caire est prescrit, il faut s\u2019en remettre aux principes g\u00e9n\u00e9raux de la prescription. En soi, le recours hypoth\u00e9caire est assujetti \u00e0 un d\u00e9lai de prescription de 10\u00a0ans, puisqu\u2019il constitue une action visant \u00e0 faire valoir un droit r\u00e9el immobilier (art. 2923 CcQ).<\/p>\n<p>Cela dit, le fait que l\u2019hypoth\u00e8que est un accessoire qui garantit le paiement d\u2019une cr\u00e9ance donne lieu \u00e0 un autre motif d\u2019extinction. En effet, le cr\u00e9ancier doit aussi respecter le d\u00e9lai de prescription de la cr\u00e9ance garantie par l\u2019hypoth\u00e8que. En ce sens, le d\u00e9lai de prescription de 3\u00a0ans de l\u2019art. 2925 CcQ s\u2019applique indirectement aux hypoth\u00e8ques.<\/p>\n<p>Il y a ainsi deux d\u00e9lais de prescription \u00e0 respecter\u00a0:<\/p>\n<ul>\n<li><strong>Prescription de l\u2019hypoth\u00e8que<\/strong>. La prescription a commenc\u00e9 \u00e0 courir le 28 novembre 2013, soit \u00e0 la date d\u2019\u00e9ch\u00e9ance de la premi\u00e8re facture impay\u00e9e. Cons\u00e9quemment, dans la mesure o\u00f9 la cr\u00e9ance n\u2019est pas prescrite, Patrick Morin avait jusqu\u2019au 28 novembre 2023 pour intenter son recours hypoth\u00e9caire. En effet, le d\u00e9lai de 10 ans court \u00e0 compter du d\u00e9faut initial du d\u00e9biteur.<\/li>\n<\/ul>\n<ul>\n<li><strong>Prescription de la cr\u00e9ance garantie par hypoth\u00e8que<\/strong>. L\u2019action sur compte du 22\u00a0juillet\u00a02015 a \u00e9t\u00e9 intent\u00e9e dans les 3\u00a0ans de l\u2019exigibilit\u00e9 des factures impay\u00e9es. Mais encore, le recours a eu pour effet de suspendre le d\u00e9lai de prescription. Depuis le jugement, Patrick Morin dispose d\u2019un d\u00e9lai de 10\u00a0ans pour le faire ex\u00e9cuter. En ce sens, sa cr\u00e9ance demeure existante et susceptible de recouvrement <em>aupr\u00e8s de<\/em> <em>l\u2019entrepreneur<\/em> jusqu\u2019au 22\u00a0septembre 2025. La cr\u00e9ance n\u2019est donc pas prescrite.<\/li>\n<\/ul>\n<p>La cr\u00e9ance n\u2019\u00e9tant pas prescrite, le recours hypoth\u00e9caire de Patrick Morin b\u00e9n\u00e9ficie de la p\u00e9riode de prescription de 10\u00a0ans pr\u00e9vue \u00e0 l\u2019article\u00a02923 CcQ \u00e0 compter de l\u2019omission initiale de 664, c\u2019est-\u00e0-dire que le recours pouvait \u00eatre intent\u00e9 jusqu\u2019au 28\u00a0novembre 2023. Le recours hypoth\u00e9caire intent\u00e9 le 10\u00a0mars 2016 n\u2019est donc pas prescrit.<\/p>\n<p><strong>Conclusion<\/strong><\/p>\n<p>Comme l\u2019illustre cette affaire, les interactions entre les diverses r\u00e8gles de prescription civiles peuvent s\u2019av\u00e9rer compliqu\u00e9es.
