Ross de la Cour supr\u00eame de Colombie-Britannique a ordonn\u00e9 la vente d\u2019une copropri\u00e9t\u00e9 situ\u00e9e \u00e0 Richmond en Colombie-Britannique apr\u00e8s avoir conclu que la propri\u00e9t\u00e9 avait \u00e9t\u00e9 achet\u00e9e \u00e0 l\u2019aide de fonds que Mary Yang et son \u00e9poux, Samuel Zhu, ont obtenu frauduleusement de Prima Technology, Inc. (\u00ab\u00a0PTI\u00a0\u00bb) en 2007. Cette proc\u00e9dure est la plus r\u00e9cente \u00e9tape des tentatives de PTI pour recouvrer les sommes des dommages-int\u00e9r\u00eats impos\u00e9s \u00e0 Mary Yang et Samuel Zhu, soit un total de plus de 11\u00a0millions de dollars am\u00e9ricains (ce qui comprend les frais de justice et les int\u00e9r\u00eats).<\/p>\n<p>M\u00eame si la copropri\u00e9t\u00e9 \u00e9tait enregistr\u00e9e au nom de la belle-m\u00e8re de Mary Yang, Yunyu Yang, PTI a fait valoir que la copropri\u00e9t\u00e9 a \u00e9t\u00e9 achet\u00e9e \u00e0 l\u2019aide de contributions financi\u00e8res vers\u00e9es par Mary Yang en 2010 et 2011. En r\u00e9ponse, Yunyu Yang a plut\u00f4t indiqu\u00e9 que les fonds utilis\u00e9s pour l\u2019achat de la propri\u00e9t\u00e9 \u00e9taient les siens.<\/p>\n<p>Apr\u00e8s examen de la preuve, la Cour en est venue \u00e0 la conclusion que, bien que Yunyu Yang d\u00e9tenait l\u00e9galement la copropri\u00e9t\u00e9, elle n\u2019a pas \u00e9t\u00e9 en mesure de prouver quelle \u00e9tait la source originale des fonds, ce qui permet de pr\u00e9sumer que la source \u00e9tait ultimement Mary Yang et donc que la propri\u00e9t\u00e9 appartenait r\u00e9ellement \u00e0 Mary Yang. La Cour a d\u00e9clar\u00e9 que la copropri\u00e9t\u00e9 devait \u00eatre d\u00e9tenue dans une fiducie constructoire pour PTI et a cons\u00e9quemment ordonn\u00e9 sa vente pour satisfaire partiellement aux p\u00e9nalit\u00e9s impos\u00e9es \u00e0 Mary Yang.<\/p>\n<p>Steven Evans (litige commercial) a repr\u00e9sent\u00e9 avec succ\u00e8s PTI dans le cadre de ces
