{"id":7443,"date":"2021-11-19T15:36:48","date_gmt":"2021-11-19T20:36:48","guid":{"rendered":"https:\/\/www.millerthomson.com\/deals-cases\/la-cour-superieure-de-justice-de-lontario-accorde-a-un-syndicat-de-coproprietaires-une-injonction-interlocutoire-contre-les-proprietaires-dunites\/"},"modified":"2024-09-12T15:24:58","modified_gmt":"2024-09-12T19:24:58","slug":"la-cour-superieure-de-justice-de-lontario-accorde-a-un-syndicat-de-coproprietaires-une-injonction-interlocutoire-contre-les-proprietaires-dunites","status":"publish","type":"deals-cases","link":"https:\/\/www.millerthomson.com\/fr\/transactions-et-causes\/la-cour-superieure-de-justice-de-lontario-accorde-a-un-syndicat-de-coproprietaires-une-injonction-interlocutoire-contre-les-proprietaires-dunites\/","title":{"rendered":"La Cour sup\u00e9rieure de justice de l\u2019Ontario accorde \u00e0 un syndicat de copropri\u00e9taires une injonction interlocutoire contre les propri\u00e9taires d\u2019unit\u00e9s"},"content":{"rendered":"<p><em>2021 ONSC\u00a07222<\/em><\/p>\n<p>Le 1<sup>er<\/sup> novembre 2021, l\u2019honorable juge Vella de la Cour sup\u00e9rieure de justice a admis en partie la requ\u00eate de la Toronto Standard Condominium Corporation n<sup>o<\/sup>\u00a02519 (la \u00ab\u00a0TSCC\u00a02519\u00a0\u00bb) et impos\u00e9 une injonction interlocutoire et une ordonnance de non-communication \u00e0 Emerald PG Holdings Ltd, \u00e0 Mehmet Fatih Eroltu alias Fatih Eroltu, \u00e0 Cameron Thomson et \u00e0 Salvatore Campione, les propri\u00e9taires d\u2019unit\u00e9s (les \u00ab\u00a0propri\u00e9taires d\u2019unit\u00e9s\u00a0\u00bb) de la TSCC\u00a02519.<\/p>\n<p>Le litige pr\u00e9sent\u00e9 par la TSCC\u00a02519 d\u00e9coule d\u2019un comportement et d\u2019une conduite de la part des propri\u00e9taires d\u2019unit\u00e9s contre le conseil d\u2019administration et le gestionnaire immobilier de la TSCC\u00a02519 entre 2017 et 2021. La TSCC\u00a02519 all\u00e8gue que les propri\u00e9taires d\u2019unit\u00e9s se sont livr\u00e9s \u00e0 des menaces de litige, \u00e0 de l\u2019intimidation et \u00e0 une hostilit\u00e9 excessive principalement sous la forme de communications par courriel et d\u2019interactions physiques. Elle a pr\u00e9sent\u00e9 une requ\u00eate pour obtenir une ordonnance de conformit\u00e9 et une ordonnance interlocutoire de non-communication en vertu de la <em>Loi de 1998 sur les condominiums<\/em> (la \u00ab\u00a0<em>Loi sur les condominiums<\/em>\u00a0\u00bb). La TSCC\u00a02519 a \u00e9galement demand\u00e9 le paiement des frais li\u00e9s \u00e0 sa requ\u00eate sur la base d\u2019une indemnisation int\u00e9grale par les unit\u00e9s d\u2019Emerald \u00e0 titre de d\u00e9pense commune recouvrable.<\/p>\n<p>Apr\u00e8s avoir examin\u00e9 les preuves pr\u00e9sent\u00e9es par les t\u00e9moins, la Cour a conclu que, m\u00eame si les propri\u00e9taires d\u2019unit\u00e9s ont le droit l\u00e9gitime de pr\u00e9senter leurs requ\u00eates et demandes au syndicat de copropri\u00e9taires, la TSCC\u00a02519 est parvenue \u00e0 fournir la preuve, selon la pr\u00e9pond\u00e9rance des probabilit\u00e9s, que la conduite des propri\u00e9taires d\u2019unit\u00e9s \u00e9tait susceptible de donner lieu \u00e0 un pr\u00e9judice psychologique qui \u00e9tait plus que de nature passag\u00e8re ou sans importance, ou qu\u2019elle nuisait de mani\u00e8re d\u00e9raisonnable \u00e0 l\u2019utilisation ou \u00e0 la jouissance des unit\u00e9s ou des parties communes par les autres propri\u00e9taires d\u2019unit\u00e9s.<\/p>\n<p>La Cour a finalement d\u00e9cid\u00e9 que les gestes pos\u00e9s par les propri\u00e9taires d\u2019unit\u00e9s constituaient du harc\u00e8lement au travail en vertu de la <em>Loi sur la sant\u00e9 et la s\u00e9curit\u00e9 au travail<\/em> et qu\u2019ils allaient \u00e0 l\u2019encontre des dispositions de la <em>Loi sur les condominiums<\/em>. Elle a accord\u00e9 au syndicat de copropri\u00e9taires une injonction interlocutoire emp\u00eachant les propri\u00e9taires d\u2019unit\u00e9s de poursuivre leurs actions. La Cour a \u00e9galement accord\u00e9 l\u2019indemnisation int\u00e9grale des co\u00fbts recouvrables aupr\u00e8s des propri\u00e9taires d\u2019unit\u00e9s \u00e0 titre de d\u00e9pense
