There was no shortage of legal appeals against the Greenhouse Gas Pollution Pricing Act (the “Act”) enacted in 2018, under which the Federal OBPS has been implemented. The Act’s constitutionality was challenged by some Provincial governments from its inception. The Act, which sets a minimum standard of carbon pricing in an effort to lower greenhouse gas (GHG) emissions, was confirmed to be constitutional by the Supreme Court of Canada (SCC) in 2021.
