Andrew M. (Sandy) Robinson, Elizabeth Ackman and Andrea Farkouh of Miller Thomson’s Toronto office have prevailed in a recent Supreme Court of Canada decision involving their client, the Toronto Catholic District School Board versus Southcott Estates, a subsidiary of Ballantry Homes Inc.
The ruling highlights how a company that is a separate entity, but is part of a larger group of companies, is obliged to mitigate damages in a case of a breach of contract.
