Tracey M. Bailey, KC has over 30 years experience in providing legal, legislative, policy and strategic advice on a wide range of issues in health law.

Tracey advises public and private health system and health professional clients on a wide range of health law matters, with a particular focus on regulatory, strategic and risk management advice, as well as strategic advice related to government relations in the health area. Her practice includes representing clients, including health authorities and health professionals, in professional regulatory or medical staff appointment matters.

She works with clients towards practical solutions to their legal issues and assists them in navigating Canada’s complex health regulatory framework in a way that will best achieve their aims. Tracey’s previous experience in both private and public practice, as well as law and policy reform work in a practically-applied academic setting, informs her work. Her past experience includes acting as Corporate Counsel for a Ministry of Health and as a senior legal advisor for government, providing advice on numerous complex issues to senior officials, and advising on legislative amendments. It also includes opinion and litigation experience for a large national firm.

She has specialized expertise in health law and has advised, published and spoken on a wide range of issues including health system governance, health care delivery, regulation of health professionals, medical malpractice, public health, mental health, pandemics, assisted death, end-of-life decision-making, handling of health information, health ethics, injury control, patient charters, apology laws, regulation of health products, consent and capacity, substitute decision-making, nosocomial infection, patient and staff abuse, patient safety, medical staff appointments and privileges, and disclosure of adverse events.

She has taught extensively in both law and health professional faculties, and given over 445 invited lectures, most recently on Regulating in a Post-Pandemic World.  She is an author of more than 70 publications (including book chapters, peer-reviewed articles, and commissioned papers and reports). She is the senior editor of and a contributor to Public Health Law and Policy in Canada, the first Canadian text on public health and the law, and recently published the 4th edition.

Tracey is an Honourary Executive Member of the Canadian Bar Association’s National Health Law Section and a past Chair, and has served on numerous committees and working groups.
