{"id":6624,"date":"2024-03-28T15:45:17","date_gmt":"2024-03-28T19:45:17","guid":{"rendered":"https:\/\/www.millerthomson.com\/get-it-done-act-2024-ontarios-expansion-infrastructure-building-homes\/"},"modified":"2025-07-10T11:37:12","modified_gmt":"2025-07-10T15:37:12","slug":"get-it-done-act-2024-ontarios-expansion-infrastructure-building-homes","status":"publish","type":"post","link":"https:\/\/www.millerthomson.com\/en\/insights\/construction-and-infrastructure-law\/get-it-done-act-2024-ontarios-expansion-infrastructure-building-homes\/","title":{"rendered":"The <i>Get It Done Act<\/i>, 2024: Ontario\u2019s legislature taking steps to expedite expansion of infrastructure and building homes"},"content":{"rendered":"\n<p>The Government of Ontario recently proposed modifications to the&nbsp;<em>Environmental Assessment Act<\/em><a href=\"https:\/\/www.millerthomson.com\/fr\/?p=12192#_ftn1\">[1]<\/a>&nbsp;(the \u201c<strong>EAA<\/strong>\u201d) through Bill 162,&nbsp;<a href=\"https:\/\/www.ola.org\/en\/legislative-business\/bills\/parliament-43\/session-1\/bill-162\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Get It Done Act, 2024<\/em><\/a>&nbsp;aimed at making it faster and easier to build infrastructure in Ontario.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Proposed changes to the EAA<\/h2>\n\n\n\n<p>Schedule 1 of Bill 162 proposes to amend section 1 of the EAA by adding the following subsection:<\/p>\n\n\n\n<p>(7) For greater certainty, under this Act, a reference to acquiring property or rights in property is a reference to acquiring the property or rights in property by purchase, lease,&nbsp;expropriation&nbsp;or otherwise. [Emphasis added]<\/p>\n\n\n\n<p>The proposed amendment notably includes \u201cexpropriation\u201d as a form of property acquisition under the EAA, signaling to expropriating authorities that they can acquire property for a project through expropriation prior to completing an environmental assessment.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">i. Environmental Assessments (EAs)<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>EAs are governed by the EAA.<\/li>\n\n\n\n<li>an EA is the provincial planning process for public infrastructure projects in Ontario.<\/li>\n\n\n\n<li>the EA process ensures that governments and public bodies, including municipalities, provincial ministries and agencies, consider potential environmental impacts before an infrastructure project begins.<\/li>\n\n\n\n<li>EAs require public consultation at multiple stages of the review process. Consultations are held with members of the public, various experts, stakeholders, and Indigenous communities.<\/li>\n\n\n\n<li>the EA process can be lengthy and cause delays to the development and building process. According to the Ministry of the Environment, Conservation and Parks, it takes a minimum of 30 weeks to review and make a decision on an individual environmental assessment, with the review taking longer if changes need to be made.<a href=\"https:\/\/www.millerthomson.com\/fr\/?p=12192#_ftn2\">[2]<\/a><\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">ii. Impact of proposed Bill 162 amendment<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Acquiring property for a project is already permitted under the EAA before the EA process is completed, however, clarifying to expropriating authorities that expropriation may occur\u00a0<em>prior<\/em>\u00a0to completing the EA process would help accelerate the timeframe for infrastructure projects, like the building of highways or hydro transmission lines.<\/li>\n\n\n\n<li>Reducing approval times helps get critical infrastructure built quickly and aids in addressing the pressing needs of the province.<\/li>\n<\/ul>\n\n\n\n<p>Bill 162 is currently in the Second Reading stage, where it was referred to the Standing Committee on Heritage, Infrastructure and Cultural Police on March 7, 2024.
