{"id":6324,"date":"2023-03-02T14:16:15","date_gmt":"2023-03-02T19:16:15","guid":{"rendered":"https:\/\/www.millerthomson.com\/estate-planning-indian-act-considerations-assisting-indigenous-clients-living-reserve\/"},"modified":"2025-12-29T14:54:30","modified_gmt":"2025-12-29T19:54:30","slug":"estate-planning-indian-act-considerations-assisting-indigenous-clients-living-reserve","status":"publish","type":"post","link":"https:\/\/www.millerthomson.com\/en\/insights\/private-client\/estate-planning-indian-act-considerations-assisting-indigenous-clients-living-reserve\/","title":{"rendered":"Estate planning and the Indian Act: Practical considerations for assisting Indigenous clients living on reserve"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">Introductory thoughts<\/h2>\n\n\n\n<p>When we began assisting Indigenous clients with status under the <em>Indian Act<\/em> with drafting their wills, we found that there were few resources that addressed estate planning or estate administration matters under the <em>Indian Act.<\/em><a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a> We soon discovered that estate planning and estate administration present several unique considerations for Indigenous peoples to whom the <em>Indian Act<\/em> applies. In this <a href=\"https:\/\/www.millerthomson.com\/en\/publications\/communiques-and-updates\/wealth-matters\/\" target=\"_blank\" rel=\"noopener\">Wealth Matters<\/a> article, we highlight several of these key considerations, with a particular focus on Indigenous peoples with status under the <em>Indian Act<\/em> and living on reserve. We have canvassed the information available and have produced this article in the hope that it will serve as a high-level resource for lawyers who assist Indigenous clients with these specific legal needs.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Context: Estate planning and estate administration<\/h3>\n\n\n\n<p>Generally speaking, estate planning is the process by which individuals anticipate and plan how to manage their assets during their lifetime and in preparation for their death or incapacity. Drafting a will is an integral part of the estate planning process, as it dictates how an individual\u2019s assets will be distributed when they die. Estate administration is the process of organizing and distributing a deceased person\u2019s assets to the beneficiaries of their estate. A person is considered to have died intestate if they do not have a valid will.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Terminology is important<\/h3>\n\n\n\n<p>The term \u201cIndian\u201d is outdated and offensive. In this article we will instead use the term \u201cIndigenous person with status\u201d \u2013 or \u201cIndigenous peoples with status\u201d \u2013 where possible. However, the term \u201cIndian\u201d still possesses legal meaning under the <em>Indian Act<\/em> as an Indigenous person \u201cwith status\u201d and thus in certain circumstances it must be used.<\/p>\n\n\n\n<p>The term \u201cIndigenous\u201d is an umbrella term for First Nations, Metis, and Inuit Peoples in Canada. However, in the context of estate planning and estate administration, the <em>Indian Act<\/em> only applies to Indigenous peoples who are members of a First Nation and have \u201cstatus\u201d under the <em>Indian Act<\/em>. Therefore, when we use the term \u201cIndigenous\u201d in this article, we are referring to someone who is a First Nations band member who has status and is living on reserve land. The term \u201cFirst Nation\u201d can describe a large ethnic grouping, such as the Cree Nation, or it can be synonymous with the term \u201cband\u201d, which describes smaller communities.<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Relevant sources of law<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">Federal legislation<\/h3>\n\n\n\n<p>Estate planning and estate administration are typically governed by provincial legislation in Canada. However, the Federal Government (or the \u201cfederal Crown\u201d) possesses exclusive jurisdiction over \u201cIndians and Land Reserved for Indians\u201d under section 91(24) of the <em>Constitution Act<\/em>, <em>1867.<\/em><a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a> This includes estate planning and estate administration matters. These powers are enacted through sections 42-50.1 of the <em>Indian Act<\/em><a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a> and the <em>Indian Estates Regulations.<\/em><a href=\"#_ftn5\" name=\"_ftnref5\">[5]<\/a> In addition, the <em>Family Homes on Reserves and Matrimonial Interests or Rights Act<\/em><a href=\"#_ftn6\" name=\"_ftnref6\">[6]<\/a> (\u201c<strong><em>Family Homes Act<\/em><\/strong>\u201d) was introduced by the Federal Government in 2013 to fill in certain legislative gaps related to the protection of spouses and common-law partners of Indigenous peoples with status who are not otherwise protected by the <em>Indian Act<\/em>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Provincial legislation<\/h3>\n\n\n\n<p>Many practitioners think provincial laws that do not conflict with the <em>Indian Act<\/em> or the <em>Indian Estate Regulations<\/em> are applicable to Indigenous peoples with status\u2019 estate planning and administration needs in accordance with section 88 of the <em>Indian Act.<\/em><a href=\"#_ftn7\" name=\"_ftnref7\">[7]<\/a> However, historical jurisprudence is not consistent on whether the <em>Indian Act<\/em> \u201cconstitutes a comprehensive testamentary code in respect of Indians\u201d: see <em>Canard v Canada AG<\/em> and <em>Re Williams Estate.<\/em><a href=\"#_ftn8\" name=\"_ftnref8\">[8]<\/a> Practitioners should therefore approach estate planning and estate administration for Indigenous clients with some caution, and be up to date with current provincial legislation.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Customary law<\/h3>\n\n\n\n<p>Customary law that does not conflict with the <em>Indian Act<\/em> may also be a relevant source of law for estate planning for Indigenous clients.<a href=\"#_ftn9\" name=\"_ftnref9\">[9]<\/a> Customary law is described as traditional law of Indigenous peoples that reflects the \u201cbroad consensus of the membership of a First Nation\u201d,<a href=\"#_ftn10\" name=\"_ftnref10\">[10]<\/a> and can include a First Nation\u2019s self-governance agreement. Interestingly, several self-governance agreements expressly override the <em>Indian Act<\/em>\u2019s wills and estates provisions and replace them with applicable provincial law, the laws of the First Nation, or specific legal standards delineated in the relevant self-government agreements for individual testators: see: <em>Westbank First Nation Self Government Agreement<\/em>;<a href=\"#_ftn11\" name=\"_ftnref11\">[11]<\/a> the <em>Sioux Valley Dakota Nation Self Government Agreement<\/em>;<a href=\"#_ftn12\" name=\"_ftnref12\">[12]<\/a> and the <em>Tla\u2019amin Final Agreement.<\/em><a href=\"#_ftn13\" name=\"_ftnref13\">[13]<\/a><\/p>\n\n\n\n<p>Where possible, customary law must be recognized as valid law to honour and respect Indigenous peoples\u2019 right to self-determination in the spirit of truth and reconciliation.<a href=\"#_ftn14\" name=\"_ftnref14\">[14]<\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">For estate planning purposes, to whom does the <em>Indian Act<\/em> apply?<\/h2>\n\n\n\n<p>The <em>Indian Act <\/em>applies to \u201cIndians\u201d (i) with status; and (ii) who \u201cordinarily reside\u201d on reserve land.<a href=\"#_ftn15\" name=\"_ftnref15\">[15]<\/a><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">With status<\/h3>\n\n\n\n<p>Indian status (or registration) provides legal standing, along with certain rights and privileges, to a person registered under the <em>Indian Act. <\/em>Eligibility is based on descent in one\u2019s family. An Indigenous person must be First Nation to receive status, but not all First Nation Peoples qualify for status. For clarity, this means that in the context of estate planning and estate administration, the <em>Indian Act<\/em> applies to First Nations and it does not apply to Metis or Inuit Peoples. Metis and Inuit Peoples are recognized as \u201cIndian\u201d under s.91(24) of the <em>Constitution Act, 1867<\/em>; however, they are not eligible to receive status under the <em>Indian Act<\/em>.<a href=\"#_ftn16\" name=\"_ftnref16\">[16]<\/a><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Ordinarily reside<\/h3>\n\n\n\n<p>Generally speaking, reserve land is land set aside by the federal Crown for the use and benefit of a particular First Nation.<a href=\"#_ftn17\" name=\"_ftnref17\">[17]<\/a> The Crown is the legal title owner of the land, but members of the First Nation have beneficial ownership and possession of the land, evidenced by way of a possessory certificate.<\/p>\n\n\n\n<p>As discussed by the Supreme Court of Canada in <a href=\"https:\/\/nextcanada.westlaw.com\/Document\/I10b717ce839763f0e0440003ba0d6c6d\/View\/FullText.html?originationContext=docHeader&amp;contextData=(sc.Default)&amp;transitionType=Document&amp;needToInjectTerms=False\" target=\"_blank\" rel=\"noopener\"><em>Canada (Attorney General) v. Canard<\/em><\/a>, \u2018ordinarily reside\u2019 has been held to mean:<\/p>\n\n\n\n<p>\u201cresidence in the course of the customary mode of life of the person concerned, and it is contrasted with special or occasional or casual residence\u2026 it connotes residence in a place with some degree of continuity and apart from accidental or temporary absences\u201d.<a href=\"#_ftn18\" name=\"_ftnref18\">[18]<\/a><\/p>\n\n\n\n<p>Accidental or temporary absences, such as medical care, will not rescind a finding of \u201cordinary resident\u201d: see <a href=\"https:\/\/www.canlii.org\/en\/ca\/fct\/doc\/2004\/2004fc897\/2004fc897.html?autocompleteStr=Earl%20v.%20Canada%20(Minister%20of%20Indian%20%26%20Northern%20Affairs)%202004%20FC%20897%20&amp;autocompletePos=1\" target=\"_blank\" rel=\"noopener\">Earl v. Canada (Minister of&nbsp;<em>Indian<\/em>&nbsp;&amp; Northern Affairs) 2004 FC 897 (F.C.)<\/a> and <a href=\"https:\/\/www.canlii.org\/en\/yk\/yksc\/doc\/2012\/2012yksc71\/2012yksc71.html?autocompleteStr=Dickson%20Estate&amp;autocompletePos=2\" target=\"_blank\" rel=\"noopener\"><em>Dickson (Estate of), 2012 YKSC 71<\/em><\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Key considerations<\/h2>\n\n\n\n<p>There are several key considerations for legal practitioners while handling the estate planning and estate administration of Indigenous peoples with status and who ordinarily reside on reserve land.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Federal ministerial powers<\/h3>\n\n\n\n<p>The Minister of Indigenous Services (the \u201c<strong>Minister<\/strong>\u201d) is granted significant authority over wills and estates governed by the <em>Indian Act<\/em>.<a href=\"#_ftn19\" name=\"_ftnref19\">[19]<\/a> This includes approving executors of an estate where there is a will, or appointing administrators where an individual died intestate.<a href=\"#_ftn20\" name=\"_ftnref20\">[20]<\/a> <em>Indian Act <\/em>wills do not need to strictly comply with provincial laws in order to be valid, as per section 15 of the <em>Indian Estate Regulations<\/em>, as the Minister may \u201cfix\u201d wills that fail to technically comply with the <em>Indian Act<\/em>. In fact, no will is of legal force or effect until the Minister has approved the will or a court has granted probate.<a href=\"#_ftn21\" name=\"_ftnref21\">[21]<\/a> It is unclear why these actions are still required to be undertaken by the Minister, rather than having such powers be delegated to the First Nations bands themselves.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Intestacy<\/h3>\n\n\n\n<p>The <em>Indian Act<\/em> imposes its own rules of estate division upon intestacy. For example, spouses are entitled only to the first $75,000 of an intestate\u2019s estate (compared to $350,000 under the <em>Succession Law Reform Act<\/em>, which applies to estates in Ontario not governed by the <em>Indian Act<\/em>).<a href=\"#_ftn22\" name=\"_ftnref22\">[22]<\/a> Further, nieces and nephews are not entitled to an intestate\u2019s reserve land: see <a href=\"https:\/\/www.canlii.org\/en\/bc\/bcca\/doc\/2003\/2003bcca299\/2003bcca299.html?resultIndex=1\" target=\"_blank\" rel=\"noopener\"><em>Okanagan Indian Band v. Bonneau<\/em> 2003 BCCA 299<\/a>.<\/p>\n\n\n\n<p>Unfortunately, intestacy is highly prevalent for Indigenous peoples with status to whom the <em>Indian Act<\/em> applies. According to a government report, approximately 90% of Indigenous peoples with status and living on reserve land die without a will.<a href=\"#_ftn23\" name=\"_ftnref23\">[23]<\/a> For context, in 2022 only 51% of Canadians who are not Indigenous peoples with status do not have a will.<a href=\"#_ftn24\" name=\"_ftnref24\">[24]<\/a> This is problematic. Where an Indigenous person with status living on reserve does not have a will, the Minister must appoint someone to administer the estate.<a href=\"#_ftn25\" name=\"_ftnref25\">[25]<\/a> This results in lengthy delays and a failure to capture the deceased\u2019s testamentary wishes. Comparatively, an intestate estate under provincial legislation is oftentimes administered by the deceased\u2019s family member.<\/p>\n\n\n\n<p>Increasing access to knowledgeable and culturally competent lawyers at an accessible cost may result in lower rates of intestacies of Indigenous peoples with status. Although the Truth and Reconciliation Commission does not directly address this, it is in the spirit of reconciliation to promote Indigenous self-governance and independence in all facets of life.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Land distribution<\/h3>\n\n\n\n<p>As discussed above, reserve land is held by the federal Crown for the benefit of a First Nation (\u201clegal\u201d title). Thus, individual Indigenous peoples with status who live on reserve land only have a possessory interest, which is evidenced by way of a possessory certificate (\u201cbeneficial\u201d title).<a href=\"#_ftn26\" name=\"_ftnref26\">[26]<\/a> Typically, off of reserve land, individuals own property in fee simple, which, put simply, means they own both the legal and beneficial title. Possessory certificates may be bequeathed only to members of the band, and the land transfer must be approved by the Minister. Often, there is poor documentation with respect to possession on a reserve, as many First Nations have their own ways of distributing land.<a href=\"#_ftn27\" name=\"_ftnref27\">[27]<\/a> Thus, certainty of tenure is not absolute. This is one of the primary challenges that must be considered while drafting wills under the <em>Indian Act<\/em>: legal professionals must consider how these rules impact a grantor\u2019s rights and a beneficiary\u2019s eligibility. The beneficiary\u2019s eligibility to receive the certificate is determined by whether they possess status under the <em>Indian Act<\/em>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Spousal relief<\/h3>\n\n\n\n<p>Under the <em>Indian Act<\/em>, common-law partners are recognized as beneficiaries. However, if the matrimonial home is on reserve land, it can only be passed on to a partner if the partner is an Indigenous Person with status. The matrimonial home is the home ordinarily occupied by a person and their spouse as their family residence, and is granted certain protections under provincial legislation.<\/p>\n\n\n\n<p>There are some remedies under the <em>Indian Act<\/em> and the <em>Family Homes Act<\/em> regarding the unique treatment of the matrimonial home. For example, the Minister may declare a will to be void if the will fails to appropriately provide for a person (i.e. a spouse or a child) for whom the testator had a responsibility to provide.<a href=\"#_ftn28\" name=\"_ftnref28\">[28]<\/a> A spouse may apply for an order for exclusive possession under section 21 of the <em>Family Homes Act<\/em>, but this is rarely successful due to housing shortages and other legal and social concerns that many reserve lands face. <a href=\"https:\/\/www.canlii.org\/en\/ns\/nssc\/doc\/2018\/2018nssc179\/2018nssc179.html?autocompleteStr=Toney%20v%20Toney%20Estate%202018%20NSSC%20179&amp;autocompletePos=1\" target=\"_blank\" rel=\"noopener\"><em>Toney v Toney Estate<\/em> 2018 NSSC 179<\/a> is one of the only published cases wherein an elderly and disabled widow without status was successful in obtaining an order for exclusive possession of the matrimonial home, which she shared with her husband, the First Nation\u2019s Chief, until his death.<\/p>\n\n\n\n<p>Alternatively, and more commonly, a spouse may make an application under section 36 of the <em>Family Homes Act<\/em> for an equalization payment with respect to the matrimonial home within 10 months of the deceased band-member spouse or common law partner\u2019s death. In many cases, enforcement of equalization payment is difficult, even where court ordered, for the same reason that exclusive possession orders are rare.<a href=\"#_ftn29\" name=\"_ftnref29\">[29]<\/a> This is contrasted with provincial treatment of the matrimonial home, where both parties are equally entitled to share in the full value at the date of separation or death regardless of who brought the home into the marriage.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Final remarks<\/h2>\n\n\n\n<p>Lawyers who serve clients whose estate planning and estate administration goals are governed by the <em>Indian Act<\/em> should have a basic understanding of the topics discussed in this paper in order to effectively meet the needs of these clients. Cultural competency and understanding is highly important in this area of the law,<a href=\"#_ftn30\" name=\"_ftnref30\">[30]<\/a> as is a basic understanding of the <em>Indian Act<\/em>, <em>Indian Estate Regulations<\/em>, and <em>Family Homes Act<\/em>.
