{"id":6292,"date":"2023-01-19T14:00:55","date_gmt":"2023-01-19T19:00:55","guid":{"rendered":"https:\/\/www.millerthomson.com\/greenwashing-canada-enforcement-trends-2023\/"},"modified":"2025-12-29T16:53:49","modified_gmt":"2025-12-29T21:53:49","slug":"greenwashing-canada-enforcement-trends-2023","status":"publish","type":"post","link":"https:\/\/www.millerthomson.com\/en\/insights\/esg-and-carbon-finance\/greenwashing-canada-enforcement-trends-2023\/","title":{"rendered":"Greenwashing in Canada: Enforcement and trends for 2023"},"content":{"rendered":"\n<p>Over the last several years, increasing demand from consumers for environmentally-friendly products and services has led to an increase in \u201cgreenwashing,\u201d which involves the practice of conveying false, misleading, incomplete, or unsubstantiated information to consumers about a product or business\u2019 environmental credentials.<\/p>\n\n\n\n<p>Canadian courts and adjudicative bodies have started recognizing the harm associated with greenwashing and, in some instances, have heavily penalized organizations for employing marketing tactics that misled consumers into believing products, goods or services were more environmentally-friendly than they are.<\/p>\n\n\n\n<p>In this article, we outline how organizations can and have been held responsible for environmental harm in Canadian courts and by adjudicative bodies in the context of breaches of both environmental protection legislation and competition legislation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">A hefty greenwashing fine under the <em>Canadian Environmental Protection Act <\/em><\/h2>\n\n\n\n<p>In September 2015, Environment and Climate Change Canada (\u201cECCC\u201d) launched an investigation of Volkswagen Aktiengesellschaft (\u201cVolkswagen AG\u201d) to assess their compliance with the federal <em>On-Road Vehicle and Engine Emission Regulations.<\/em><a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a> In the investigation, ECCC found that Volkswagen AG had imported into Canada vehicle models that were equipped with \u201cdefeat devices,\u201d which contain software that reduces the effectiveness of a vehicle\u2019s emission control system while it is operating and in use. Between January 2008 and December 2015, Volkswagen AG imported into Canada nearly 128,000 two and three-litre diesel engine Volkswagen and Audi vehicles equipped with defeat devices. ECCC also revealed that the use of the defeat devices \u201cinvolved significant deception and showed that the company knowingly circumvented national vehicle emissions regulations.\u201d<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a> In a 2020 decision on this matter, the Ontario Court of Justice ordered Volkswagen AG to pay $196.5 million after it pled guilty to 60 charges of offences under the <em>Canadian Environmental Protection Act <\/em>for misleading information and unlawfully importing vehicles that failed to meet vehicle emissions standards.<a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The Competition Bureau takes on Greenwashing Investigations<\/h2>\n\n\n\n<p>Canada\u2019s Competition Bureau, a federal government agency which \u201cprotects and promotes competition\u201d to benefit consumers and businesses,<a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a> has investigated multiple complaints against organizations regarding allegations of greenwashing.<\/p>\n\n\n\n<p>As part of its mandate, the Competition Bureau investigates alleged violations of the laws it enforces. The laws that pertain to greenwashing under the Competition Bureau\u2019s purview are as follows:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><em>The Competition Act <\/em><\/h3>\n\n\n\n<p>The <em>Competition Act<\/em> contains provisions addressing false or misleading representations<a href=\"#_ftn5\" name=\"_ftnref5\">[5]<\/a> and deceptive marketing practices<a href=\"#_ftn6\" name=\"_ftnref6\">[6]<\/a> in promoting the supply or use of a product or any business interest. The <em>Competition Act<\/em> provides two adjudicative regimes to address false or misleading representations and deceptive marketing practices: a criminal regime and a civil regime, respectively.<\/p>\n\n\n\n<p>The criminal regime, outlined in section 52(1) of the <em>Competition Act<\/em>, creates a general criminal prohibition against misleading advertising by prohibiting all materially false or misleading representations made knowingly or recklessly. The civil regime, outlined in section 74.01 of the <em>Competition Act<\/em>, specifically prohibits making representations to the public for the purposes of promoting a product, service or business interest that is false or misleading in a material respect.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><em>The Consumer Packaging and Labelling Act <\/em><\/h3>\n\n\n\n<p>The <em>Consumer Packaging and Labelling Act <\/em>contains provisions regarding representations on labelling for non-food consumer goods. Section 7 of this Act prohibits a dealer from making false and misleading representations about a product which relates to or may reasonably be regarded as relating to that product.<a href=\"#_ftn7\" name=\"_ftnref7\">[7]<\/a><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><em>The Textile Labelling Act<\/em><\/h3>\n\n\n\n<p>The <em>Textile Labelling Act <\/em>contains provisions regarding the labelling, sale, import and advertising of consumer textile goods. Similar to the <em>Consumer Packing and Labelling Act<\/em>, section 5 of the <em>Textile Labelling Act<\/em> prohibits a dealer from making false and misleading representations about a product which relates to or may reasonably be regarded as relating to that product.<a href=\"#_ftn8\" name=\"_ftnref8\">[8]<\/a><\/p>\n\n\n\n<p>In recent years, the Competition Bureau has begun conducting inquiries on certain organizations based on complaints that have alleged breaches of the above noted provisions.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Keurig pays nearly $4M for false recycling claims<\/h2>\n\n\n\n<p>In early 2022, the Competition Bureau concluded that Keurig Canada Inc. (\u201cKeurig\u201d) had made false or misleading claims about the recyclability of its single-use coffee pods, given that K-Cup pods are currently not widely accepted in municipal recycling programs outside of British Columbia and Quebec.<\/p>\n\n\n\n<p>The Competition Bureau and Keurig agreed to a settlement agreement in which Keurig paid a $3 million penalty as well as made an $800,000 donation to a Canadian charity focused on environmental causes and paid $85,000 to cover the Competition Bureau\u2019s investigation costs.<a href=\"#_ftn9\" name=\"_ftnref9\">[9]<\/a> As part of this agreement, Keurig is also required to change its packaging and widely publish notices about these changes.<a href=\"#_ftn10\" name=\"_ftnref10\">[10]<\/a><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Ongoing inquiry into the Canadian Gas Association<\/h3>\n\n\n\n<p>Last fall, several doctors, nurses and public health advocates, with the support of the Canadian Association of Physicians for the Environment, filed a complaint to the Competition Bureau alleging that the Canadian Gas Association (\u201cCGA\u201d) made false and misleading representations to the public that natural gas is \u201cclean\u201d and \u201caffordable.\u201d<\/p>\n\n\n\n<p>As natural gas is composed of 70-90% methane, which is significantly more powerful at trapping heat than carbon dioxide,<a href=\"#_ftn11\" name=\"_ftnref11\">[11]<\/a> the complainants argued that it is misleading to refer to natural gas as clean. The complainants also disputed that natural gas is affordable, given that heat pumps are typically less expensive than gas residential energy systems, and the cost of natural gas is expected to increase significantly in coming years due to climate policies.<a href=\"#_ftn12\" name=\"_ftnref12\">[12]<\/a><\/p>\n\n\n\n<p>In November 2022, the Competition Bureau informed the CGA that it had opened an inquiry regarding messaging around natural gas. The inquiry remains ongoing at this time. Should the Competition Bureau find that the statements are false and\/or misleading, the company would be forced to halt the advertisements, issue a retraction, and could be ordered to pay a fine of up to $10 million.<a href=\"#_ftn13\" name=\"_ftnref13\">[13]<\/a><\/p>\n\n\n\n<p>The Competition Bureau also has an ongoing greenwashing inquiry against one of Canada\u2019s biggest banks regarding its messaging on climate action.<a href=\"#_ftn14\" name=\"_ftnref14\">[14]<\/a><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Complaint filed against the Sustainable Forestry Initiative<\/h3>\n\n\n\n<p>In December 2022, several large Canadian environmental organizations filed a complaint with the Competition Bureau alleging that the Sustainable Forest Initiative\u2019s (\u201c<strong>SFI<\/strong>\u201d) descriptions of its forestry certification standard as \u201csustainable\u201d, \u201ccertified sustainable\u201d, or achieving \u201csustainably managed forests\u201d were false and misleading.<\/p>\n\n\n\n<p>The complainants allege that SFI\u2019s forestry certification standard outlines steps which<em> could<\/em> result in sustainable forestry, but does not <em>require<\/em> any practices that meet definitions of \u201csustainable\u201d or \u201csustainable forestry\u201d or \u201csustainable forest management.\u201d<a href=\"#_ftn15\" name=\"_ftnref15\">[15]<\/a><\/p>\n\n\n\n<p>The SFI is the largest forest certification system in North America and has certified more than 140 million hectares of forest in North America.<a href=\"#_ftn16\" name=\"_ftnref16\">[16]<\/a> The complainants allege that the SFI provides assurances of sustainable forestry while contributing to unsustainable logging globally and in Canada on an immense scale.<a href=\"#_ftn17\" name=\"_ftnref17\">[17]<\/a><\/p>\n\n\n\n<p>The Competition Bureau has yet to publicly launch an inquiry into the SFI.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Complaint filed against Gazoduq<\/h3>\n\n\n\n<p>In June 2021, the Centre Qu\u00e9b\u00e9cois du Droit de L\u2019Environnement (\u201cCQDE\u201d) filed a complaint with the Competition Bureau against Gazoduq Inc. (&#8220;Gazoduq\u201d) and its majority shareholder, Soci\u00e9t\u00e9 en commandite Symbio Infrastructure (\u201cSymbio\u201d), arguing that Gazoduq and Symbio repeatedly made false and\/or misleading representations to the public about their proposed project to construct and operate a pipeline to transport methane gas from Western Canada to Saguenay, Quebec. In the complaint, the CQDE alleged that Gazoduq and Symbio falsely claimed this project would be carbon neutral and globally reduce greenhouse gas emissions.<a href=\"#_ftn18\" name=\"_ftnref18\">[18]<\/a><\/p>\n\n\n\n<p>The Competition Bureau has yet to publicly launch an inquiry into this complaint, and the project is currently being assessed through an integrated impact assessment led by the Impact Assessment Agency of Canada.<a href=\"#_ftn19\" name=\"_ftnref19\">[19]<\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Takeaways<\/h2>\n\n\n\n<p>As evident from the investigations of Keurig and the CGA, the Competition Bureau is taking an active role to address greenwashing in Canada. In 2021, the Competition Bureau archived a 2008 document prepared by the Competition Bureau and the Canadian Standards Association to guide industry and advertisers on environmental claims,<a href=\"#_ftn20\" name=\"_ftnref20\">[20]<\/a> stating that the document \u201cdoes not reflect the latest standards and evolving environmental concerns.\u201d<a href=\"#_ftn21\" name=\"_ftnref21\">[21]<\/a> This, unfortunately, leaves businesses with little guidance from the Competition Bureau on greenwashing.<\/p>\n\n\n\n<p>This past March, the European Commission proposed several amendments to the Unfair Commercial Practices Directive and the Consumer Rights Directive which, if adopted, would provide further clarity for companies to avoid greenwashing within the European Union. Companies would be required to substantiate environmental claims using the Product\/Organization Environmental Footprint Methods, which call for the use of 16 environmental impact categories to measure the environmental performace of a product or organization through its entire value chain and lifecycle.<\/p>\n\n\n\n<p>The proposed amendments also call for the prohibition of several commercial practices, including the following:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>displaying sustainability labels that are not based on a certification scheme or established by public authorities;<\/li>\n\n\n\n<li>making an environmental claim about an entire product when the claim only concerns a certain component of the product;<\/li>\n\n\n\n<li>failing to inform consumers about features that limit the durability or repairability of a product or making false claims about the durability or repairability of a product; and<\/li>\n\n\n\n<li>failing to inform consumers that a product uses consumables, spare parts or accessories that are not provided by the original producer.<a name=\"_ftnref22\" href=\"#_ftn22\">[22]<\/a> <a name=\"_ftnref23\" href=\"#_ftn23\">[23]<\/a><\/li>\n<\/ul>\n\n\n\n<p>As domestic and international laws and policies to address greenwashing continue to evolve, businesses ought to tread carefully before making environmental claims about their products, goods and services. Businesses ought to ensure that any claims made are:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Not misleading or likely to result in misinterpretation;<\/li>\n\n\n\n<li>Accurate and specific: ensure that broad claims that a product is environmentally beneficial are accompanied by a supporting statement and that claims do not imply a product is endorsed by a third-party organization unless it is;<\/li>\n\n\n\n<li>Substantiated and verifiable;
