These exemptions form part of the <a href=\"https:\/\/gazette.gc.ca\/rp-pr\/p2\/2021\/2021-09-01\/html\/sor-dors200-eng.html\"><em>Exemptions from and Modifications to Hours of Work Provisions Regulations<\/em><\/a> SOR\/2021-200 (the \u201cRegulations\u201d).<\/p>\n\n\n\n<p>In 2019, several provisions were added to Part III of the <em>Code <\/em>with the aim of providing employees with greater predictability around hours of work and shift scheduling. When these amendments were made, transportation employers expressed concern that the scheduling rules threatened the efficiency, reliability and financial viability of the transportation and logistics services upon which Canadian businesses and consumers depend. The new Regulations appear to be a response to those concerns.<\/p>\n\n\n\n<p>Once in force, the Regulations will exempt certain employees from some of those hours of work and scheduling rules. In particular, the following sections of the <em>Code<\/em> will be impacted by the new exemptions and modifications:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>s. 173.01<\/strong>: Employers shall provide employees with their work schedule in writing at least <em>96 hours<\/em> before the start of the employee\u2019s first work period or shift under that schedule, and, subject to some exceptions, an employee may refuse to work any work period or shift in their schedule that starts within 96 hours from the time that the schedule is provided to them.<\/li>\n\n\n\n<li><strong>s. 173.1<\/strong>: Employers must provide employees with at least <em>24\u00a0hours<\/em>\u2019 written notice of a shift change or addition.<\/li>\n\n\n\n<li><strong>s. 169.2: <\/strong>Every employee is entitled to and shall be granted a rest period of at least<em> 8 consecutive hours<\/em> between work periods or shifts.<\/li>\n\n\n\n<li><strong>s. 169.1: <\/strong>Every employee is entitled to and shall be granted an unpaid break of at least <em>30 minutes<\/em> during every period of five consecutive hours of work. If the employer requires the employee to be at their disposal during the break period, the employee must be paid for the break.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Exemptions to Hours of Work and Scheduling Provisions by Employee Class<\/h2>\n\n\n\n<p>The Regulations will provide exemptions from and modifications to the hours of work provisions for the following specific classes of employees.<\/p>\n\n\n\n<p><strong>E <\/strong>= exempt from provision.<\/p>\n\n\n\n<p><strong>M <\/strong>= modification: employees are entitled to at least a 30-minute break for every period of 5 consecutive hours of work, which can be split into periods of at least 15 minutes and provided at any time during the work period or shift.<\/p>\n\n\n\n<p><strong>N\/A <\/strong>= no exemption or modification.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table><thead><tr><th>Employee Class<\/th><th class=\"has-text-align-center\" data-align=\"center\">s. 173.01 (96 hour notice of schedule)<\/th><th class=\"has-text-align-center\" data-align=\"center\">s. 173.1 (24 hour notice of shift <strong>change<\/strong><\/th><th class=\"has-text-align-center\" data-align=\"center\">s. 169.2 (8 hour rest period)<\/th><th class=\"has-text-align-center\" data-align=\"center\"><strong>s. 169.1 (30<\/strong> min break)<\/th><\/tr><\/thead><tbody><tr><td>Highway motor vehicle operators and city motor vehicle operators in the road transportation sector who operate a motor vehicle for the transport of goods with a gross combination weight rating over 4,500 kg<\/td><td class=\"has-text-align-center\" data-align=\"center\">E<\/td><td class=\"has-text-align-center\" data-align=\"center\">E<\/td><td class=\"has-text-align-center\" data-align=\"center\">E<\/td><td class=\"has-text-align-center\" data-align=\"center\">E<\/td><\/tr><tr><td>Highway motor vehicle operators and city motor vehicle operators in the postal and courier sector who operate a motor vehicle for the transport of mail or parcels<\/td><td class=\"has-text-align-center\" data-align=\"center\">N\/A<\/td><td class=\"has-text-align-center\" data-align=\"center\">E<\/td><td class=\"has-text-align-center\" data-align=\"center\">N\/A<\/td><td class=\"has-text-align-center\" data-align=\"center\">M<\/td><\/tr><tr><td>Motor coach operators who are not employed by a municipal or provincial transit authority<\/td><td class=\"has-text-align-center\" data-align=\"center\">E<\/td><td class=\"has-text-align-center\" data-align=\"center\">E<\/td><td class=\"has-text-align-center\" data-align=\"center\">E<\/td><td class=\"has-text-align-center\" data-align=\"center\">E<\/td><\/tr><tr><td>Armoured car crew members<\/td><td class=\"has-text-align-center\" data-align=\"center\">N\/A<\/td><td class=\"has-text-align-center\" data-align=\"center\">E<\/td><td class=\"has-text-align-center\" data-align=\"center\">N\/A<\/td><td class=\"has-text-align-center\" data-align=\"center\">N\/A<\/td><\/tr><tr><td>Warehouse workers who handle, move, load and unload materials by hand or by means of material handling equipment, shippers, and receivers<\/td><td class=\"has-text-align-center\" data-align=\"center\">N\/A<\/td><td class=\"has-text-align-center\" data-align=\"center\">E<\/td><td class=\"has-text-align-center\" data-align=\"center\">N\/A<\/td><td class=\"has-text-align-center\" data-align=\"center\">N\/A<\/td><\/tr><tr><td>Dispatchers<\/td><td class=\"has-text-align-center\" data-align=\"center\">N\/A<\/td><td class=\"has-text-align-center\" data-align=\"center\">E<\/td><td class=\"has-text-align-center\" data-align=\"center\">N\/A<\/td><td class=\"has-text-align-center\" data-align=\"center\">N\/A<\/td><\/tr><tr><td>Mechanics<\/td><td class=\"has-text-align-center\" data-align=\"center\">N\/A<\/td><td class=\"has-text-align-center\" data-align=\"center\">E<\/td><td class=\"has-text-align-center\" data-align=\"center\">N\/A<\/td><td class=\"has-text-align-center\" data-align=\"center\">N\/A<\/td><\/tr><\/tbody><\/table><figcaption class=\"wp-element-caption\">This table summarizes the exemptions and modifications to hours of work provisions that apply to different classes of employees.<\/figcaption><\/figure>\n\n\n\n<p>Also, as of <strong>February 1, 2022<\/strong>, the <em><a href=\"https:\/\/www.canada.ca\/en\/employment-social-development\/programs\/laws-regulations\/labour\/interpretations-policies\/scope-application.html\">Interpretation, Policies and Guidelines (IPG) 101<\/a><\/em> will no longer apply to the road transportation, postal and courier, marine, and grain sectors.
