The Act amends the <em>Employment Standards Act, 2000<\/em> to require provincially-regulated employers in Ontario to provide employees with up to three days of paid leave for reasons related to&nbsp;COVID-19, including that the employee is:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>going for a\u00a0COVID-19\u00a0test<\/li>\n\n\n\n<li>staying home awaiting the results of a\u00a0COVID-19\u00a0test<\/li>\n\n\n\n<li>being sick with\u00a0COVID-19<\/li>\n\n\n\n<li>going to get vaccinated<\/li>\n\n\n\n<li>experiencing a side effect from a\u00a0COVID-19\u00a0vaccination<\/li>\n\n\n\n<li>having been advised to self-isolate due to\u00a0COVID-19\u00a0by an employer, medical practitioner or other authority<\/li>\n\n\n\n<li>taking care of a dependent who is:\n<ul class=\"wp-block-list\">\n<li>sick with\u00a0COVID-19\u00a0or has symptoms of\u00a0COVID-19<\/li>\n\n\n\n<li>self-isolating due to\u00a0COVID-19<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p>Employers will be required to pay employees up to $200 a day (or their regular rate of pay, if less than $200) for up to 3 days. Employers can then apply for a reimbursement from the Ontario government of the amounts paid to the employee.<\/p>\n\n\n\n<p>The paid days of leave do not need to be taken consecutively. Employers should note that employees are not required to provide a medical certificate in order to be eligible for this leave.<\/p>\n\n\n\n<p>Employees who already receive an equal or greater amount of paid sick leave through their employer are not eligible for this benefit.<\/p>\n\n\n\n<p>This leave will be available until September 25, 2021 and is retroactive to absences since April 19, 2021.<\/p>\n\n\n\n<p>With the introduction of this leave, Ontario is the fourth province to provide for paid COVID-19 vaccination leave after <a href=\"https:\/\/www.millerthomson.com\/en\/publications\/communiques-and-updates\/labour-and-employment-communique\/march-19-2021-labour\/paid-vaccination-leave\/\">Saskatchewan<\/a>, <a href=\"https:\/\/www.millerthomson.com\/en\/publications\/communiques-and-updates\/labour-and-employment-communique\/april-22-2021-labour\/alberta-creates-covid-19-vaccine-paid-leave\/\">Alberta<\/a> and <a href=\"https:\/\/www.millerthomson.com\/en\/publications\/communiques-and-updates\/labour-and-employment-communique\/april-28-2021-le\/paid-covid-19-vaccination-leave-in-place-for-b-c\/\">British Columbia<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Interaction with the Canada Recovery Sickness Benefit<\/h2>\n\n\n\n<p>For longer term absences, the Government of Canada currently offers the Canada Recovery Sickness Benefit (CRSB).
