{"id":5661,"date":"2020-07-30T11:21:52","date_gmt":"2023-08-12T08:04:04","guid":{"rendered":"https:\/\/www.millerthomson.com\/bill-32-restoring-balance-in-albertas-workplaces-act-passed\/"},"modified":"2024-09-16T11:09:24","modified_gmt":"2024-09-16T15:09:24","slug":"bill-32-restoring-balance-in-albertas-workplaces-act-passed","status":"publish","type":"post","link":"https:\/\/www.millerthomson.com\/en\/insights\/labour-and-employment\/bill-32-restoring-balance-in-albertas-workplaces-act-passed\/","title":{"rendered":"<i>Bill 32: Restoring Balance in Alberta\u2019s Workplaces Act<\/i> passed"},"content":{"rendered":"<p>On July 29, 2020, Bill 32: <em>Restoring Balance in Alberta\u2019s Workplaces Act, 2020<\/em>, received Royal Assent and became law in Alberta (the \u201c<em>Act<\/em>\u201d).<\/p>\n<p>The <em>Act <\/em>makes a number of significant changes to labour and employment legislation in Alberta, including changes pertaining to:<\/p>\n<ul>\n<li>notice of group terminations;<\/li>\n<li>the amount of time that an employer has to pay an employee their final pay upon termination of employment;<\/li>\n<li>calculation of general holiday pay;<\/li>\n<li>permitted deductions from employee earnings;<\/li>\n<li>temporary layoffs;<\/li>\n<li>hours of work averaging;<\/li>\n<li>youth jobs;<\/li>\n<li>accumulation of vacation time during a leave of absence;<\/li>\n<li>rest periods;<\/li>\n<li>the ability to override certain <em>Employment Standards Code <\/em>provisions in a collective bargaining agreement;<\/li>\n<li>union dues and financial disclosure;<\/li>\n<li>first contract arbitration;<\/li>\n<li>picketing;<\/li>\n<li>remedial certification;<\/li>\n<li>the reverse onus rule;<\/li>\n<li>early renewal of a collective bargaining agreement;<\/li>\n<li>consequences of prohibited practices by a union;<\/li>\n<li>union disciplinary powers;<\/li>\n<li>inclusion of nurse practitioners;<\/li>\n<li>certain labour relations rules that are specific to the construction industry;<\/li>\n<li>the powers of an arbitrator; and<\/li>\n<li>the powers of the Alberta Labour Relations Board.<\/li>\n<\/ul>\n<p>For more information about these changes, read our<a href=\"https:\/\/www.millerthomson.com\/en\/publications\/communiques-and-updates\/labour-and-employment-communique\/july-10-2020-labour\/bill-32-albertas-proposed-restoring-balance-in-albertas-workplaces-act\/\"> July 10, 2020 communique about the introduction of Bill 32<\/a>.<\/p>\n<p>Changes to the <em>Employment Standards Code<\/em> will take effect on November 1, 2020, except for three changes that will take effect on August 15, 2020:<\/p>\n<ul>\n<li>notice of a group termination;<\/li>\n<li>length of temporary layoffs; and<\/li>\n<li>flexible rules to apply for variances to the <em>Employment Standards Code<\/em>.<\/li>\n<\/ul>\n<p>Most changes to the <em>Labour Relations Code<\/em> will take effect immediately. The remaining changes, including the following, will take effect upon Proclamation:<\/p>\n<ul>\n<li>access to union financial statements\/opt-in for union dues;<\/li>\n<li>early renewal of collective agreements;<\/li>\n<li>rules for secondary picketing;<\/li>\n<li>\u201call-employee\u201d units in the construction sector;<\/li>\n<li>building trades of Alberta project agreements;<\/li>\n<li>Alberta Labour Relations Board standard of review; and<\/li>\n<li>including nurse practitioners in the <em>Labour Relations Code<\/em>.<\/li>\n<\/ul>\n<p>This article provides a high-level overview of only some the key changes from Bill 32.
