The recent case of <em>Holmes v. Modry<\/em>, 2025 BCSC 430 (<em>Holmes<\/em>), in the BC Supreme Court serves as a stark reminder of the severe legal consequences that can arise when these responsibilities are breached, especially in cases where large sums of money are involved.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The case<\/h2>\n\n\n\n<p>In <em>Holmes<\/em>, the British Columbia Supreme Court found that the defendant had grossly breached his fiduciary duties while acting as an attorney under a POA for his late uncle and aunt.
