{"id":23230,"date":"2024-12-06T10:19:37","date_gmt":"2024-12-06T15:19:37","guid":{"rendered":"https:\/\/www.millerthomson.com\/?p=23230"},"modified":"2025-06-24T13:07:08","modified_gmt":"2025-06-24T17:07:08","slug":"bill-26-major-changes-to-albertas-health-legislation","status":"publish","type":"post","link":"https:\/\/www.millerthomson.com\/en\/insights\/health\/bill-26-major-changes-to-albertas-health-legislation\/","title":{"rendered":"Bill 26: Major changes to Alberta\u2019s health legislation"},"content":{"rendered":"\n<p>On October 31, 2024, Alberta\u2019s Minister of Health, Adriana LaGrange, introduced Bill 26, known as the <em>Health Statutes Amendment Act, 2024 (No. 2) <\/em>(the \u201c<strong>Bill<\/strong>\u201d or \u201c<strong>Bill 26<\/strong>\u201d).<a href=\"#_ftn1\" id=\"_ftnref1\">[1]<\/a> The Bill, which passed third reading on December 4, 2024<a href=\"#_ftn2\" id=\"_ftnref2\">[2]<\/a>, proposes significant changes to several of Alberta\u2019s health laws, including the <em>Provincial Health Agencies Act<\/em><a href=\"#_ftn3\" id=\"_ftnref3\">[3]<\/a>, the <em>Public Health Act<\/em><a href=\"#_ftn4\" id=\"_ftnref4\">[4]<\/a>, the <em>Health Facilities Act<a href=\"#_ftn5\" id=\"_ftnref5\"><strong>[5]<\/strong><\/a><\/em>,and the <em>Health Professions Act<\/em><a href=\"#_ftn6\" id=\"_ftnref6\">[6]<\/a>. Minister LaGrange stated that the Bill will continue the Government\u2019s work to \u201crefocus the health care system, provide clarity on issues that matter to Albertans, and preserve choice for minors identifying as transgender or gender diverse.\u201d<a href=\"#_ftn7\" id=\"_ftnref7\">[7]<\/a><\/p>\n\n\n\n<p>The proposed changes to Alberta\u2019s health legislation would have major impacts on the provincial healthcare system, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Limiting the surgical and pharmaceutical options available to transgender or gender-diverse youth below the age of majority;<\/li>\n\n\n\n<li>Setting the stage for the winding up of Alberta Health Services as a regional health authority and further health system transformation through the introduction of \u201cprovincial health corporations\u201d;<\/li>\n\n\n\n<li>Authorizing a provincial health agency to enter into agreements with chartered surgical facilities; and<\/li>\n\n\n\n<li>Modifying the definition of \u201cpublic health emergency\u201d for the purposes of the <em>Public Health Act<\/em>.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Amendments to the <em>Health Professions Act<\/em><\/h2>\n\n\n\n<p>The proposed amendments to the <em>Health Professions Act<\/em> (\u201cHPA\u201d) would prohibit regulated members from performing surgical procedures to treat gender dysphoria or gender incongruence (as defined in the Bill) on anyone under 18 years of age.<a href=\"#_ftn8\" id=\"_ftnref8\">[8]<\/a> The list of prohibited procedures includes breast augmentation, hysterectomy, phalloplasty, vaginoplasty, and other surgical procedures which the Minister may prohibit through regulations.<a href=\"#_ftn9\" id=\"_ftnref9\">[9]<\/a><\/p>\n\n\n\n<p>The Bill would also amend the HPA to prohibit the prescription of certain drugs to minors for the purposes of hormone therapy (including puberty suppression and hormone replacement therapy) to treat gender dysphoria or gender incongruence.<a href=\"#_ftn10\" id=\"_ftnref10\">[10]<\/a> The Government of Alberta states that \u201cexceptions would be made for minors aged 16 and 17 with parental, physician and psychologist approval, and for minors who have already been prescribed hormone replacement therapies to treat gender dysphoria or gender incongruence.\u201d<a href=\"#_ftn11\" id=\"_ftnref11\">[11]<\/a> These exceptions are not set out within the Bill; rather, a subsequent Ministerial Order would outline the details of any exception(s).<a href=\"#_ftn12\" id=\"_ftnref12\">[12]<\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Amendments to the <em>Provincial Health Agencies Act<\/em><\/h2>\n\n\n\n<p>The proposed changes to the <em>Provincial Health Agencies Act <\/em>(\u201cPHAA\u201d), and corresponding amendments to numerous other statutes, largely concern the introduction of \u201cprovincial health corporations.\u201d This entity has been established as the vehicle to be used to reincorporate the province\u2019s current regional health authority, Alberta Health Services (\u201cAHS\u201d), when it is wound up as a regional health authority and refocussed for the delivery of acute care hospital services. According to the Government of Alberta, the changes to the PHAA \u201clay the groundwork for [Alberta\u2019s] new health agencies to begin operations.\u201d<a href=\"#_ftn13\" id=\"_ftnref13\">[13]<\/a><\/p>\n\n\n\n<p>A provincial health corporation would be established through regulation, and could do any or all of the following:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Act in an advisory capacity to a Minister or health authority, agency, corporation or council;<\/li>\n\n\n\n<li>Deliver or coordinate the delivery of health services;<\/li>\n\n\n\n<li>Deliver or coordinate the delivery of administrative or operational services related to the health care system; and<\/li>\n\n\n\n<li>Any other activities assigned to the provincial health corporation by the regulation(s).<a id=\"_ftnref14\" href=\"#_ftn14\">[14]<\/a><\/li>\n<\/ul>\n\n\n\n<p>The amendments would also add the Minister of Infrastructure to the list of \u201csuccessors\u201d in the PHAA, and allow for the transfer of real property held by the regional health authority (i.e. AHS), as well as real property, if any, which has previously been transferred to another successor under PHAA section 5.03(1)(b), to the Minister of Infrastructure.<a href=\"#_ftn15\" id=\"_ftnref15\">[15]<\/a><\/p>\n\n\n\n<p>Additionally, the PHAA amendments would relieve provincial health agencies consisting of only one member from the obligation to hold public meetings. Such agencies would, however, be required to publish (or make publicly available) all decisions regarding the business and affairs of the provincial health agency within 72 hours of the decision (subject to exceptions).<a href=\"#_ftn16\" id=\"_ftnref16\">[16]<\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Amendments to the <em>Public Health Act<\/em><\/h2>\n\n\n\n<p>The main proposed change to the <em>Public Health Act <\/em>(\u201cPHA\u201d) relates to the definition of \u201cpublic health emergency.\u201d Under the current PHA, a \u201cpublic health emergency\u201d means an illness, health condition, epidemic or pandemic disease, novel or highly infectious agent or biological toxin, or presence of a chemical agent or radioactive material, which poses a significant risk to the public health.<a href=\"#_ftn17\" id=\"_ftnref17\">[17]<\/a> Bill 26 would amend this definition, such that a \u201cpublic health emergency\u201d would exist where there is an \u201c<em>urgent and temporary occurrence or threat of an occurrence<\/em>\u201d of one of the enumerated events or illnesses which poses \u201ca significant risk to the public <em>of an increase in disease, injuries, disabilities or deaths in excess of expectations during times of normalcy<\/em>\u201d.<a href=\"#_ftn18\" id=\"_ftnref18\">[18]<\/a> This amendment alters the definition of \u201cpublic health emergency\u201d within the PHA; however there has been little information or debate on this specific change.<\/p>\n\n\n\n<p>The other proposed amendments to the PHA involve the addition of a preamble, and the introduction of provincial health corporations to certain sections.<a href=\"#_ftn19\" id=\"_ftnref19\">[19]<\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Additional proposed amendments<\/h2>\n\n\n\n<p>As with the PHAA amendments, the HSAA would introduce the concept of \u201cprovincial health corporations\u201d to various other Alberta laws<a href=\"#_ftn20\" id=\"_ftnref20\">[20]<\/a>, including the <em>Government Organization Act<\/em><a href=\"#_ftn21\" id=\"_ftnref21\">[21]<\/a>, the <a><em>Freedom of Information and Protection of Privacy Act<\/em><\/a><a href=\"#_ftn22\" id=\"_ftnref22\">[22]<\/a>, the <em>Health Information Act<\/em><a href=\"#_ftn23\" id=\"_ftnref23\">[23]<\/a>, and the <em>Labour Relations Code<\/em><a href=\"#_ftn24\" id=\"_ftnref24\">[24]<\/a>.<\/p>\n\n\n\n<p>The HSAA also proposes to amend the <em>Health Facilities Act<\/em>, which regulates the management and operation of chartered and other non-hospital surgical facilities within Alberta.<a href=\"#_ftn25\" id=\"_ftnref25\">[25]<\/a> The amendment would allow a provincial health agency to enter into agreements for insured surgical services provided by a chartered surgical facility.<a href=\"#_ftn26\" id=\"_ftnref26\">[26]<\/a> Currently, only a regional health authority can enter into such agreements.<a href=\"#_ftn27\" id=\"_ftnref27\">[27]<\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Summary<\/h2>\n\n\n\n<p>As detailed above, Bill 26 proposes significant changes to the landscape of health legislation in Alberta,
