Preparing for August 29, 2022: Upcoming Changes to Alberta’s Builders’ Lien Act

The date for proclamation of the long-awaited modernization of Alberta’s builders’ lien framework is set. August 29, 2022, will see the Builders’ Lien Act rechristened as the Prompt Payment and Construction Lien Act. Accompanying the proclamation date are regulations which further elaborate the prompt payment and adjudication system created by the revisions.

  • prompt payment procedures, including requirements for “proper invoices”;
  • new provisions relating to holdback release and Certificates of Substantial Performance;
  • updated lien timelines and changes to types of lienable work;
