In the second session, Post-Termination Bonus Entitlements: What Ontario and Alberta Employers Need to Know, we examine recent judgments from the courts in Ontario and Alberta that may affect employee entitlements to bonus and incentive payments following termination.
Two recent decisions from the Ontario Court of Appeal and another pending before the Alberta Court of Appeal have held that employees terminated without cause may nonetheless be entitled to bonuses and other incentive payments despite language in the plan documents that requires active employment as of the date of the payment.
