Forced labor in North American supply chains has emerged as a major issue for importers to include as part of their compliance programs. This is attributable to the USMCA’s absolute prohibition against the importation of goods made with forced labor and the subsequent actions taken by USMCA parties to introduce forced-labor-related compliance and enforcement mechanisms. Notwithstanding these positive legal and regulatory developments, the presumptions, procedures, and enforcement dynamics that characterize U.S., Mexican, and Canadian forced labor practices are quite disparate. The uncertainty that flows from this evolving situation can introduce compliance and enforcement risks for North American importers and exporters.
