Biography
Mr. Auclair's main fields of experience include bankruptcy and insolvency, commercial litigation, banking law, debtor-creditor relations, enforcement of security, business restructuring, construction litigation, shareholder disputes and law of religious institutions.
Mr. Auclair provides his services and expertise to financial institutions, trustees, business planning and turnaround consultants, companies, developers and shareholders.
Among his major achievements, Mr. Auclair negotiated the acquisition of a major manufacturing company from a trustee in bankruptcy and helped relaunch this business, with the resulting preservation of several hundred jobs.
He has also been involved in various major restructurings and issues involving companies having sought court protection from their creditors.
Mr. Auclair has also acquired extensive experience as an arbitrator and has been involved in ground-breaking litigation concerning disciplinary measures affecting trustees in bankruptcy.
Mr. Auclair has gained noteworthy experience in the law of religious institutions, representing various churches and individuals in disputes of a proprietary, corporate, administrative and disciplinary nature.
Mr. Auclair has extensive experience before various courts, both in first instance and at the appellate level, including the Supreme Court of Canada.
Mr. Auclair is known for his mastery of French and English. An avid linguist, Mr. Auclair has a basic knowledge of Italian, Russian and Chinese. He can get along in Japanese and has studied several other languages.
Among his extra-curricular activities, he practices and teaches Karate. A 3rd degree black belt, he also has acted as a referee in numerous Karate Tournaments. He has written several published articles on Karate and the Martial Arts, and is recognized as an authority on the history of Karate.
Mr. Auclair is also a keen golfer, musician and artist, pastels and oils being his preferred mediums.
Within the firm, Mr. Auclair is known for his breath of knowledge, ease of approach, availability to help out and work with younger lawyers and originality in dealing with complex or innovative issues and situations.
