Profile

Luxmen Aloysius is a lawyer in the Real Estate group.  His practice focuses on condominium law and the acquisition, disposition, leasing and financing of real estate assets.  He has acted on behalf of condominiums, property managers, major developers, retailers, banks, commercial and public entities with respect to the conveyance, leasing, financing and management of real estate assets and interests.

In his condominium practice, he works with condominium boards and property managers in matters relating to corporate governances and operational issues.  This has included successfully negotiating and settling amendments to shared facilities agreements, licence agreements (including construction licence and telecommunication agreements) and easement agreements.  He also has experience in the successful resolution of issues faced by condominiums with adjacent land owners and individual unit owners.

In his development practice, Luxmen has represented developers and lenders on various projects throughout the province of Ontario, including standard high rise condominium developments, freehold subdivision developments, multi-phased mixed use developments and vacant land condominium projects.  He has been involved in all stages of the development process from initial acquisition of land, development of land (including negotiating and settling site plan development agreements) to final sale of individual units and homes.    Luxmen has worked closely with various municipal and regional bodies at all stages of the development process.

In his financial services practice, Luxmen has acted on behalf of both borrowers and lenders in the financing of all types of income producing assets, leaseholdfinancing and land acquisitions and development financing.

In his leasing practice, Luxmen has acted on behalf of both landlords and tenants in the leasing of commercial, retail, industrial and office assets.

Luxmen provides a high standard of service to his clients, focusing on practical and cost-effective solutions to help achieve his clients’ objectives.

  • Acted on behalf of a large North American Retailer with respect to a series of internal reorganizations involving multiple steps and over $500 million in real estate assets across the country.
  • Acted on behalf of a grocery chain with respect to the re-organization of its real estate holdings, involving transfers of registered and beneficial interests using a trust structure.
  • Acted on behalf of a developer with respect to the acquisition, financing and development of a freehold and condominium mixed use development in Toronto.
  • Represented a public entity with respect to the investment in a major downtown core development using a limited partnership structure.
  • Acted on behalf of a borrower in connection with a credit facility with respect to a proposed development of a high-rise residential condominium building and related amenities.
