Profile
David Chodikoff specializes in Tax Litigation (Civil and Criminal) and International Tax Dispute Resolution. He represents clients in tax disputes with government tax authorities before the courts.
David began his career in 1989, as a solicitor in The Advisory, Commercial and Property Law Section of the Ontario Regional Office (ORO) of the Department of Justice Canada (DoJ). Among his many accomplishments, he worked on the ground and gate leases for the Terminal 3 Project at Toronto’s Pearson International Airport.
From 1990 to 2003, David was a member of the Tax Law Services Section of the ORO-DoJ. He represented the Minister of National Revenue in hundreds of tax cases. In 2003, David was presented with a Department of Justice Merit Award and was also seconded to the Federal Prosecution Service in Toronto. As a Crown prosecutor, David had his first opportunity to conduct jury trials. In May 2004, David returned to the Tax Law Services Section of the ORO-DoJ. As an advocate for the public interest, he has appeared before Ontario's Court of Justice, Superior Court of Justice and Court of Appeal as well as the Tax Court of Canada, the Federal Court and the Federal Court of Appeal. David was a member of the Executive Committee and the Advocacy and Government Relations Liaison of the Taxation Law Section of the Ontario Bar Association in 2006, 2007 and 2008. In 2008, he became a member of the Executive of the International Law Section of the Ontario Bar Association.
Among his many teaching experiences, David was a national instructor in the National Programme for Advocacy Training with the Department of Justice Canada (2000-2004); faculty instructor for the Tax Litigation Skills Certificate Program at The Advocate's Society (2001, 2002, 2004 and 2008); instructor for the Ontario Bar Admission Course’s Skills Seminar, Business-Tax Law and Real Estate components (1996 to 2005) and instructor (Floater) for the new Skills and Professional Responsibility Program (2006); and supervisor for the University of Toronto, Faculty of Law, 2007-2012 Upper Year Moot.
David is frequently asked to speak on the subjects of advocacy and taxation in both the public and private sectors and has been quoted in the news and business media, including an appearance on Report on Business Television’s SqueezePlay, and in MoneySense Magazine’s feature “Everyone’s Guide to Tax Shelters” and Christie Blatchford’s column entitled “The police, the taxman and the wink” in The Globe and Mail. David is the conceptualizer, co-editor and a contributor to Advocacy & Taxation in Canada (Irwin Law, 2004), the first book of its kind in the country. (All of the author proceeds go to the Canadian Cancer Society). He is also the co-editor and a contributor to Taxation & Valuation of Technology (Irwin Law, 2008). Furthermore, David is the senior Canadian editor of The Tax Advisor's Guide to the Canada-U.S. Tax Treaty (Carswell, loose-leaf 2008 - ). David is the conceptualizer, co-editor and contributor to Taxation, Valuation and Investment Strategies in Volatile Markets (Carswell, 2010).
In 2009, Mr. Chodikoff was invited to become a Member of the Editorial Board of “It's Personal (Preserving Wealth for People and Private Companies)”, a Thomson-Reuters publication. He also authored a chapter entitled “E-Commerce: Canadian Considerations of Residency, Permanent Establishment and the GAAR” in Global E-Commerce Business and Taxation, Oxford University Press, Inc. and Internet Business Law Services Inc., a Joint Publication (2009). David co-authored a chapter entitled "Business Valuation Experts on Trial: A Canadian Perspective”, in Valuing A Business in Volatile Markets, Carswell, 2010.
In June 2009, David was elected to the Executive of the Taxation Law Section of the Ontario Bar Association for 2009-2010, and was one of the editors of the Taxation Law Section newsletter. In 2010, David was selected as an honored lifetime member for inclusion in Montclair's Who's Who Among Law Professionals in North America. In June 2010, he was elected as Vice-Chair of the Executive of the Tax Law Section of the Ontario Bar Association for 2010-2011. In June 2011, David became the Chair of the Executive of the Tax Law Section of the Ontario Bar Association for 2011-2012. As Past Chair, David continues to sit on the Executive of the Tax Law Section of the Ontario Bar Association for 2012-2013.
In July, 2012, David was appointed to the Investment Committee of the Global Kingdom Equity Fund. The Fund is a Shariah complaint private real estate equity fund focused on residential, commercial and industrial investment opportunities for well-located properties and projects in strong Canadian markets.
In August, 2012, David was invited to sit on the Advisory Committee of an emerging technology solution within the retail industry. CountMeIn, the world’s most advanced shopping and gifting platform, bridges the gap between social media and retail commerce (see: CountMeInApp.com).
In February 2013, David was informed that he was selected as a leading tax practitioner and would be included in the Canadian Lexpert Legal Directory, 2013, in the category of Litigation – Corporate Tax.
David continues to work on a number of books scheduled to be published in 2013-2014. David is the general editor of the forthcoming book Tax Litigation, A Multi Jurisdictional Comparison, First Edition (2013), for The European Lawyer Reference Series, published by Sweet and Maxwell, a UK based division of Thomson Reuters. He is also the author of the forthcoming book Tax Evasion and the Demise of Global Banking Secrecy (2014). David is also at work again with Jim Horvath on their fourth book together, entitled Taxation and Valuation of a Business - Lets Get Practical, due out in 2014.
